Well, they tell me that 'the funds are confescated'. What happens to it. Does it go to the bankroll? Does it go to the site creators? Does it go to the mods? Is it waiting for nothing in eternity?

Browsewrap agreements generally dont do well in court.
I dont think there is a clickwrap on registration, right? You should consider this just in case.

You accepted those rules and confirmed that you have read them/understood them.
It's not the fault of the site that you didn't read the ToS before accepting it, you cannot claim to be unaware of the rule,
or if you want to, you have to accept it's your responsibility.
