let us see what happens next. eventually HF and its customers comes to a good solution for both sides. some deliveries and some refunds. our goal should not be to liquidate the company in the long run but it depends very strong on the HF attitude.

The silence does seem deafening! Although best guess is they are swamped with all hands on deck trying to solve whatever problems they have before the Dec 31 deadline, and clearly there must be some issues or they would be shipping already. But on the upside, better they are still trying to work through things than not, otherwise it is likely game over for HF and their customers as shouting and screaming isn't going to bring refunds whether in USD or BTCs if they have already spent the funds on NRE / paying their supply chain. If the funds have been spent, then better take the deliveries than not, late or otherwise and hope the MPP will be delivered sooner. otherwise the other solution is for them to self mine with the returned equipment, otherwise I can't see where they will get funding for the refunds. Note this doesn't apply only to HF but also to other start ups with limited funding such as CT

Solid advice but, companies like hasfast, BFL and other mining equipment suppliers represent a major part of the bitcoin industry.
If people just sit there and take it from liars and thieves how are we supposed to recommend bitcoin to friends and family.
I'm not suggesting people to bend over and take it if they believe they've been wronged. I think the situation with mining vendors right now is a major risk to the Bitcoin ecosystem (primarily because small sane individuals are unlikely to invest in mining gear in the current climate, hurting our decentralization).

I'm just attempting to say that if you plan on doing something you should make a full commitment. A half measure of just rejecting the shipment and then doing nothing about it will only hurt you.

Would you like to bet a modest amount, let's say 0.5BTC, that you will not mine monday evening? We can use a respectable escrow of your choice. Thinking they will actually ship before they post a single screenshot of the machine hashing is... let's say optimistic, not to use the hard words.

Al kinds of conspiracy theories come to mind. Maybe HF knows they won't have enough chips for MPP, and decided to get themselves a good lawyers and go the refund route. They can immediately resell the miners, this time without the MPP. Specially if they have in mind to screw up everyone doing only partial BTC refunds, with the US$ as accounting currency on the day of the payment. If they have to have legal issues, better to have them now, otherwise they will have them when they are not able to deliver the MPP, those cases are much harder for them to defend than these partial refunds.
