That's a rape. If a person force to have sex then that's called as a rape if that's agaisnt his/her will. Force sex is a criminal offense.

Yes, it is considered rape because it is done through force. No matter what the outcome is, it is still rape. Even a husband who force his wife to have sex with him is considered rape, marital rape.
