I wonder if anyone is actually going to sue. It seems like there are threats every other thread but never real action.
It would clearly be in their best interests to simply return the coin using the next round of fool's money.

If you are looking to explain this issue to a litigator, then he'll want to see a few things up front:

1) what are the terms of that governed the transaction?
2) what is the timeline of the parties' statements and representations (who did/said what when)?
3) how many orders were placed and who placed them?
4) what was the cost of each order and the total orders?
5) what orders were/were not shipped?

This information isn't always available, of course.  Nonetheless, a class action suit needs a few informed, passionate lead plaintiffs to communicate information like this to their lawyer.

One thing to consider... what if the report just ends up making BTC and BFL more well known?  It could happen.

Ah, that is the intention. Making them well known for the lies, bait and switch tactics, unprofessional behavior and clear violation of trade law. I could only hope.

They try to push people who bought SingleSC to buy the upgrade. There is no way I'm gonna do that. I would rather buy from any other competitor. This strategy is really unbelievable and unrespectful.

I said it before on BFL forums, but I got deleted. I'll say it again here, where you cannot pretend the issue doesn't exist:

BFL: You cannot win this. Do the right thing - refund your customers if they want out. And if you have run out of money, I believe you are legally obligated to file for bankruptcy. If you continue what you are doing, you are committing a large/scale fraud and you will end up in jail.

I drove by BFL a couple of days ago and the parking lot was full but the Huber Construction company is in the same buidling, so no way to tell who is who.

If they got 20-30 complaints in a weeks time and someone who lives there contacted the local news you would make a difference.

Joshua, why does the company you represent violate FTC regulations with your no refund policy? Why do you believe that what you say supersedes the law? The reality you live in has a population of one, that is you if you couldn't figure it out. Would you like to bet 100 BTC that the Monarch will not meet the specs you have put forth for the form factor?

Time to sue Butterfly Labs as their is plenty of evidence to support that they are fraudulent with their activities. They are still taking preorders for their SC line of products with a two month delivery time, which is not possible and misleading per the shipping Blogs rate of production or lack thereof, or more is non specific. The Monarch is being offered currently for a December delivery and Joshua has said on his little forum that you will not get it till February if ordered now, purposefully misleading unsuspecting customers into the bait and switch. Plus countless other lies that Joshua on behalf of BFL has told its customers.

And a Public Service Announcement!
If you have ordered from BFL and have not yet received your product, you are entitled to a refund whenever you request one (per FTC rules).
First ask Butterfly Labs for one, they will probably say no but you might get lucky.
If you ordered via PayPal you can file a complaint with them even if you are outside the 45 day window. One customer has already gotten a refund from PayPal that was outside the 45 days.
If you ordered via BTC or Bank wire, you can fill out a complaint with the FTC and they will advocate for you with BFL to get your refund. You can also contact the office of the Kansas Attorney General and inform them that you have had your money taken with no product delivered for months, just more promises.
