Don't know if anybody has said it yet, but there is the whitelist request thread, that is a simple way to get around the 5 post limit.
As a current level of newb and close to four hours of reading my conclusions are this: Everything that is trying to be prevented is still occurring. Posts such as "this is my 5th post" are not helpful and only extend a thread when people are looking for information. The four hours to me is neither here nor there as I am new to mining and trying to get as accurate information as possible.
So what is the fix you ask? I'll be honest and say that there isn't one simply because getting people to agree on anything is a challenge. If you lower the 5 post 4 hour minimum then people will whine about the amount of spam by newbs or anyone else for that matter. If you leave it intact you continue to get people posting (whining) that they have to make 5 posts and read for four hours for the topic of all five of their initial posts. This thread contains some really good proposals for how to solve the problem but then the other human factor rears it's ugly head and it's called human laziness. No one wants to invest the effort to implement the fix so it will continue to spiral.

newbiejail.org supposedly works... but I doubt it.
Same problem were, 5 post is no problem, but 4 hours... something BIG is going on and i'm tied up.... I'll figure out a solution 
I agree, five posts are no big deal, but if you want to join in a current discussion four hours is a long time to wait. The forum post you were watching might have died or moved on in that time.
The five posts are not an issue, the four hour activity is when I just wanted to let someone on the forum know about a problem before I went to bed, oh well.
I don't see the 4 hour 5 post as a problem at all, it took me about 10 hours before i even started my first hello post.... I been reading a lot, and learned a lot, and tested a lot on my own and haven't had the need to say anything in here until now that i feel more comfortable with everything
I suspect you'll be a great asset to the community

Yeah I am still waiting, but I think this way is best. Got to keep the trolls and spammers out. I've been reading Satoshi old posts, mind blowing stuff!

Making 5 posts isn't that hard, you know.
being logged 4 hours may be harder esp if your clock is broken
