Ray now has all copies of Batch 1 orders/invoices along with the statement from Cara clearly stating a full BTC refund is in order if they do not ship.

Will post more updates when I hear back from Ray.

We aren't waiting for our Babyjets, we requested a refund and now are pursuing legal action for full refund in Bitcoin.

Some ppl on the main thread predicted that they may file for bankruptcy and it looks like they are not doing that as of now.
If they file for bankruptcy, our money will be gone, legal method. Such a shame, it's so easy to scam people legally.

If they file for bankruptcy, it's entirely possible that the bankruptcy trustee would be able to demand back every miner they've sent so far and any cash refunds they've issued. We face no greater risk from their potential bankruptcy filing than we would if we just took the miner, or the USD refund.

Lets just hope it doesn't happen. I believe there must be a reason for HashFast to be so willingly giving USD refunds. That reason in my opinion is that they do know that they have put themselves in the position in which ppl can actually ask for BTC refunds. Fingers crossed.

Well at least the ball is rolling in one way or another.

Just heard back from Ray.

He advised to reply back stating, again, what I have been (I will not accept a check, I am requesting full BTC refund)- and I did so.

I'm gathering all the paperwork necessary now and will have that compiled/organized and sent to him/Marc (asst?) by end of day.

Just wondering, how many other group buys is he helping? Is he helping only us or us and a whole bunch of other people as well?

Wow, I love that note from Hash Fast stating that merely cashing the check means you accept the terms and conditions of their refund.  They're doing their very best to avoid a full BTC refund.

Just received a USD refund letter + check in response to my original full BTC payment refund request on Nov 10 and Jan 2:

I did not fill out their USD refund & release form and did not request this. Getting so tired of these games.

The way I am reading this is they are at least capable of usd refund which is sort of good news.

Getting a USD refund has never been an issue at all- that has been readily available since the 31st- but I do not agree with that type of refund at all.

Some ppl on the main thread predicted that they may file for bankruptcy and it looks like they are not doing that as of now.

There was no source to that claim- I think it was people just talking out of their *** - or doing scare tactics etc. But again, who knows?  Undecided

I'm glad Ray responded. At this point, it looks like we have no choice but to go with the lawyer route, since HashFast is forcing USD refunds on customers.

The chance of HF going bankrupt is rather low, since they still have quite the number of new customers pre-ordering their products. The lawyer also seems great. 40% is a small price to pay to win this, considering HF has also hired a lawyer and is clearly preparing for war against their customers in court.

I think we have a good chance of winning this case.

I know you can sue people left and right in the US, but not familiar how these type of cases work.


what he said is that he will try. Hope that works fine for all of us... goo lawyer.. go.. and if you make us get back our btc post your adress for donations.

Kicking HF ass is something I would like the most. No matter which way. They thought that there is a place for 2nd bfl and they need to be proven wrong.

Of course I still want my 40 btc or so back. Even 60%.

I've told you that you were not authorized to ask any kind of refund without our vote. Who gave you the right to ask for a BTC refund when you were warned again and again not to do that because HF is just waiting for a excuse not to ship the miners & MPP? You've done that just to get all this away from yourself, as I've said it's not your money so you just don't care. The quote you gave: "I reserve the right to make any changes to the above in favor of each investor’s best interest." - how is getting US$ refund translating to each investors best interest?

You seem not to get the simple fact: It was obvious a month before the Dec 31st deadline there would be no full BTC refunds. Against everybody best judgment and our warnings, and without putting it to a vote, you've requested any kind of refund. Who gave you the right to do that?

It seems you have some authority issues. I am not sure if it's a right forum to deal with that...

What are you talking about? There's nothing personal against Waldo in all this. He just notified us today that HF confirmed his refund request, and I'm responding to it. I'm shocked he made any kind of refund request, he always said he didn't do any formal request, and now we now that *our* refund request is accepted.
