It's not like this is a new company touting impossible specs. They've been around for more than a year (formerly known as gridseed) and have delivered all miners without any significant issues AFAIK.
Gridseed had quite a few issues with their units, in fact. The original orbs were widely reported to have VERY bad QC and poor design, the "80" blades were BADLY underengineered and tended to eat their power voltage converter circuitry a LOT - but they DID deliver reliably, just that the stuff they delivered had VERY BAD board-level engineering. Their GC3355 CHIPS however seemed to work well.
From what I've seen about the SF100 so far, that appears to NOT have changed.

There is NO such law to my knowlage at the federal level. There is a RECOMMENDATION out of the FTC that does not in fact have force of law on that subject.

Selling used gear as new, however, is an open-and-shut case of fraud under US consumer protection laws - if it can be proved that the item WAS in fact used when it was sold as new. There are some outs though - like cars that are test-driven can still be sold as new as long as they get the full factory warentee, and electronic gear that goes through burn-in testing by the manufacturer is still counted as new.
I've not seen Zoomhash doing that to date, but my sample size of gear bought from them is fairly small.
your right i was thinking of the implied warranty all most all states have . I will try to find out what Steal series meant mybad . they told me the US warranty in the US is for one year on new products by law and the EU warranty extends longer . I guess I miss understand just what they meant . but I went and looked after you said NO such law your right .was going by what steal series told me they replaced it after i sent it in they had make sure it was defective which is normal and fair .

Don't test-driven drien car have a limit on the miles it driven before that's not true or it is used. but yea it if sold as new and is used you can prove it then it's fraud. key word prove it .
that may hold up diff didn't really pay much attention to it about cars it may fall under a diff complaint if they try to claim it as a burn-in testing etc and the dealer can't say that's on the manufacturer any more either . but its a real pain in the but to get thu it all . might not be worth the hassle . and your state would handle that i think it said .
