There are plenty of pools finding blocks without orphans. Notnull has payed out around 134954361.298 coin, no orphans for a while. http://kit.notnull.org/index.php?page=statistics&action=blocks

Hi, im mining in that pool already because they gave some benefits and bonus, i have recieved 13k coins in bonus and mining at 0%fee, i didnt configure the autowithdraw then when i logged last time a message said me i had to withdraw, i have done and recieved all the coins. They are working as i havent seen before in other pools.
I can post captures if you need

The pool operator is the one in the position to launch a 51% exploit, not the individual miners.
And it doesn't matter whether or not that pool operator seems likely to engage in such shenanigans; what matters is the apparent trustworthiness of the network.
If someone's going to capture 51% of the network every time a major pool goes down, then the coin will simply not be considered secure.

If it was, it was only for a very short period - but I agree we do need to get some more pools up to mitigate this risk. With only 2 or 3 pools operating, it's bound to happen that one of them will go over the 51% mark
