....... If we obtain the judgment we have requested, we will attempt to execute on that judgment and find assets that still belong to the companies to distribute to the investors.  At the moment, we are not aware of substantial assets to return.
 

So I got jacked, but figured I'd never see a dime of it so when they eventually wanted more info from the people going in on the class action, I went "whatever" but more power to everyone who stuck in there. Anyway, I felt I had to point out in the above quote... "still belong to the companies" the way I "heard" that was.. well he stole the money straight out of the company coffers so you are sol.. OR Well the company assets included btc but he totally sold that for cash and it's gone. (add any other variations you want but all ending with you are SOL)

Nice personal reply, good work. Maybe you could mention to her that she could reach out to the community here for help in tracing blockchain-based transactions, with a mind to potentially uncovering funds Homero may have stashed away.


Are there hidden funds in the blockchain? Shinners alluded to there being hidden money but I have never seen any evidence presented here.  The only thing we know about was the brattleboro home.  That was sold Feb 9 2016 for $286,600 with about a $100,000 profit.  Where is that money?    Maybe it was in Carlos's name?  Haven't heard much about the real estate.  Wonder what Carlos has been up to too?

Pretty sure that's why GAWSUIT started to collect fees from Muggles, then decided not to.

Now they legally owe nothing to anyone.

Morally & Ethically.....can go to hell!

Due to the extreme amount of stupidity shown by everyone involved, I wouldn't put it past these geniuses to not get any money up front, and believe the guy who conned them that they would be able to get money out of Fraser this way.

It's still weird that the whole response to the SEC case was "I'm pleading the 5th". You'd think the Wall Street superstar lawyers could have found a way to reject at least some of the allegations without self-incrimination. The nice thing about pleading the 5th in a civil case is that this fact itself can be used against Garza. In other words the SEC can say "Garza pleading the 5th means he's guilty AF" (albeit in a more lawyerish language perhaps). However all this might not mean much since Ms. Shields is basically admitting that the SEC doesn't expect to recover any significant assets. Homero is likely giving up on the SEC case, has weaseled out of the class action, and is probably hoping for a lenient outcome in the criminal investigation.

Well, at least we're getting some movement in this saga. Long overdue.

Sadly we gotta wait for a court case (if any) to find out the details.
I had my final bankruptcy hearing today.  I've had some financial problems unrelated to this, but getting my $1500 would be nice.  I asked my attorney if he had ever heard of a SEC fraud case being delayed and that delay being confidential.  He listed off a number of things that could be confidential, didn't write them down, but none of them made sense in this case.  I wonder if anyone has a list of those things that is more knowledgeable?

yeah I'm wondering if the clue might be the double sealed extensions over the past 6 months is where the AG is at. I imagine Uncle Stu's lawyers would have had a field day pointing to a criminal investigation against Homero and not Uncle Stu, had it been ongoing for a long time, unless of course they are after him too.  I think on this front all we can wait for his a picture in the paper of a handcuffed Homero being escorted up a long flight of concrete steps.  Cheesy  I just don't know how long it can still take. They pretty much got everything they ever need in the research and evidence that the SEC already dug up plus whatever snippets they can glean from Shinner's own investigations.  Would still be quiet surprised if the AG only kicked into gear in say 2016. Why so long and what exactly set them off.  Too much time has passed, witness memories faded, evidence long lost etc etc.
