HashFast would have to prove that they didn't store the BTC somewhere. They would have to prove that they converted it at an exchange.
You could also subpoena Hashfast records and hire an investigator to comb through HashFasts BTC transactions log to figure out what happened to the BTC.
They have kept some of the Bitcoin they were sent.  I have posted one of the addresses already in this thread.

Edit2: If you look through the transactions you can see some end points still are in [large cache's of] BTC. Whether it remains in hashfasts hands or not is up to an investigator.

My second BTC purchased miner has also been forced refunded without any communication with Hashfast.

Talking to an actual HF employee (i.e. Cara, rather than their service), seems to be impossible (so far).

Welcome to the party Joshv06.   This is what we are trying to figure out.
So far, ONLY people that paid with BTC have been forced refunds and ONLY batch one.
You are now the third batch 1 that paid USD and has NOT received a refund, and one of those three actually requested a refund and still has not received it.

@DeaDTerra, with the amount of people involved in IceDrill how come nobody can come out and give any update at the most crucial time ?

I can give you guys a quick update.
We have received several test units that worked well, so we know that HF has the tech ready to go.
Two of ID members are currently in Canada, preparing the DC and waiting for full scale production to start.
We will have our Sierras soon.
Everything is ready to go and at the moment we are waiting for HashFast.
We are currently discussing with HashFast regarding the delay of the units and the failure to deliver within the guaranteed date.

So, you have a bunch of people who have received checks:
- They are all Batch I
- They are from USA and Canada (so not isolated to USA residents)
- They all paid with bitcoin

Two people, from batch one have NOT received checks and they both paid with US Dollars and one of them (dbbits) actually requested a refund.

AFAIK Canada is in North America which IMO makes them American too.



 Canadian's do not identify themselves as Americans. Being on the same "North American" continent means little.
