Sure, but the laws concerning refunds for unshipped products applies to BFL equally and many BFL customers will have lost a far larger part of their investment than any HF customer, assuming the latter starts shipping soon.

Not to defend HF, but Im slightly surprised about the legal steps being taken against them if you consider that to my knowledge, no one has taken BFL to court yet. And that is despite BFL not offering any refunds whatsoever, and being way later than HF. Being "only" a month late (so far) and being offered full USD refunds is something BFL victims can only dream off.

HF stated clear delivery dates and made various promisses (like full BTC refunds) that BFL never did.

So, my unsolicited attempted buyout arrived, FedEx was able to find/google/call me even though that thing was sent to a nonexisting street adress (yes, in fact: "650 Castro St", located here in Berlin/Germany).

As From-address they listed:

[email protected]
100 Bush Street
San Francisco, CA 94104
USA

(So this seems to be "the" confirmed address of them, btw.)

I still don't believe the arbitration clause in the purchase agreement will hold any water. It's not done right, and without ever shipping you a product, they have not fulfilled the basic premise of the purchase agreement. Forget arbitration, sue them in every court you can.

Count me in on standing with whoever wants to take Hashfast to court for screwing us over with their scam. I want my 57BTC back.

If you want in on the mass action, simply email [email protected] with your personal info and order confirmation.

There are many things we can find HF guilty of, so it won't be a problem to have an award with what we deserve from the arbitrator. After that they will probably decide that they don't want to pay, and we will do whatever necessary to have what we deserve, or equivalent, out of their three companies (probably more?).

If that fails too, we will have lost a bit of money for the bigger cause. And in that case we will try, i have no idea of how, but i at least will try, to have the state go after them for the fraud they committed. The legal system after all is there for this reason, and it's just fair.

There must be a reason if the only report of HF employee leaving the company we have is... From the one that was studying law. Right? Smart girl...

PS: and if i die in a car accident before that i guess that it being a verifiable fact, the community will run the second part of my plan, the one that has to do with the state and the frauds.

If things devolve to forced arbitration instead of full BTC refunds - like they promised us, the DZ Miners Cooperative is down for teaming up with forum members for a mass action to help spread the pain of pre-payment of setting up arbitration, and any other follow on actions to get our full BTC back (oh,  and to make HF pay for arbitration and legal costs, for making us have to go through this instead of doing the right thing).

We have 2 upgraded BJs on order from Batch 1, 2 Sierras from Batch 2, and a whole bunch of disappointed miners. No update to my "support ticket", so far.

Edit2: I should state that scenario would only be true if HF really did sell off all of it's customers property (BTC) to USD at some point in the past. They would need 10x to buy it back and put it in the hands of the rightful owners. Screwed~!
Since that we purchased miners and they proved to have them working, and possibly metric tons of them working, i think that the majority of us would welcome a fair amount of hashing power at a definite moment in time instead of the deserved refund.
I know you probably don't want to say anything publicly about your case.

Are you making the case that HF took your funds to develop a product (the BabyJets and Sierras) and then when it came time to deliver they simply returned 10% of your converted BTC property in USD rather than the full amount?

Are you trying to say that HF had no intention to deliver on it's end? (MPP and the original hardware?)

Edit: Actually, your right, if you didn't go for the 10% USD refund, you might be able to recoup the equivalent of the HF settlement through the use of the machine plus its MPP and then sell it all off to a third party. You'd never be made whole. But you'd be stupid to ultimately take their settlement...which seems to be very little in light of that thinking.

It is probably the worst case scenario you could possibly imagine. (Well besides them going bankrupt)

Edit2: I have a legal question, does this mean that HF is targeting BTC payors "unfairly"? Even if people didn't request a refund they are still being given a fraction of what they originally gave.

Does this mean that HF has no intention to deliver the hardware + MPP if you originally paid with BTC? Say it ain't so!

Do batch 2 clients get the extra 5% with our refund?
Assuming there are any HF funds left to dispense?

If Batch 1 is successful, I am pretty sure Batch 2 through 4 will probably sue Batch 1 folks for the USD recompense. Though we all know in a sane world that is not possible.

If they only had 600k from familial investors, and the rest (approx, 15 Million according to businessweek) came from you all....then HF would only have about 600k if all funds were returned to their customers. Minus the costs to date @ 28nm and R&D...

50BTC per Batch 1 order.
x 200 orders ~
= 10,000 BTC (obviously some of that was straight forward USD payments...so it is nowhere near that)

10,000 BTC @ Todays rate
x 840 USD
= 8.4 Million

10,000 BTC @ Yesterdays rate
x 100 USD
= 840,000

Edit: And if you do the math like HF wants it:

1,000 BTC
x  100
840,000 USD (@ ~ -90% deduction)

Free dictionary thingey is wrong.  Several does not mean more than three.  It means more than two.
