This can't be legal (as in, they can't really believe we will eat all of this shit).

Dear Batch 1 Customers,

Although HashFast has enough Golden Nonce ASICS for all Batch 1 orders, our initial modules (Rev 0) had reliability issues due to the PCB layout (Printed Circuit Boards). We have now received 2nd  rev PCBs, and they are currently being assembled and will then be tested. 

Despite these challenges we did begin shipping our very first  Batch 1 orders today. These units were hand-built, tuned and tested.  We have not yet started bulk production due to continued debugging efforts on the latest PCB revision. 

We had hoped to resolve reliability issues sooner so that we could begin bulk production and be on track to ship Batch 1 customer orders on December 31.  However, issues have not been adequately resolved, and therefore we are unable to ship the remaining outstanding orders by December 31st. 

For customers who would like to request a refund, please do the following:

Not only was there an arbitration clause most courts want you to mediate before trial anyways.  Also HF did the it's only for commercial use not for retail customers thing because by law it means you were a sophisticated customer not some consumer who should believe random Internet postings.  All these other moves are a waste of time and money.

That isn't always true. You haven't received your product, your rights as a consumer are different than if you had bought and received something under a term of sale including arbitration. Hashfast will try and ship you something, because then they have completed the sale process and you would be suing for damages because of the late shipment. That part would probably be stuck in arbitration. They may currently be guilty of criminal fraud, and the arbitration won't mean a damn thing recovering damages if they were found guilty. Anti SLAPP laws in CA will prevent them from trying to sue the victims of their breach of contract for libel.

Why would anyone "start arbitration long time ago [sic]"? Until there was a failure to deliver on Dec. 31 there was no claim to arbitrate.
cedivad is claiming that dec 31 was not the original promise anyways and that he already asked for a refund that was denied.  Everyone keeps bringing up laws for HF to follow but a clear arbitration clause you think doesn't apply?  Lawyers just wanted extra fees because he was going to end up in arbitration anyways before court.

Actually i think that the arbitration point is the only one that doesn't go directly against our interests. The only problem is that it's a binding arbitration, so you have only once chance and have to make it work.

That sounds great and you know its got to be true ;-)

I reccomend someone take a screenshot of that and keep it as proof of 500ghash as if/when most of us get our units and they are only/barely 400 there will be issues

This NEW YEAR starts with bad news to some if they shipped yours.

Unless it showed up today, it doesn't make any difference. From HashFast's Terms of Sale:

3.       DELIVERY AND QUANTITIES.

(a)     Guaranteed Baby Jet Delivery Dates – Batch 1.  All of the 550 Baby Jet units from Hashfast’s first production batch are guaranteed for delivery by December 31, 2013 [emphasis mine].  If Buyer ordered one or more units of such Baby Jets, and Hashfast does not deliver such units by that date, then Buyer may cancel the undelivered portion of the order at Buyer’s request and Hashfast will provide a refund for the units that Buyer purchased but did not receive and cancelled.

So unless it showed up today, HashFast is bound by the ToS to give a refund. They're ALSO bound to refund the full BTC paid by the ToS in effect at the time Batch 1 was ordered as well as the representations of their agents, but getting that out of them is likely going to involve a court fight as they've made quite clear they don't intend to honor that part of the contract.

This is a public discussion forum and minternj posed a question. After a few pages of back and forth, the pool operator finally stepped forward and cleared your name. You made no statement of any kind until today. Now you have resolved the issue, and thank you for clarifying.

But why *delete* the thread?

Also, your point on that topic is off-topic in this particular thread, so please address any response in the appropriate thread.



More on topic: is that you long ago announced the specs for the new ASIC and confirmed that it is 400GH/s. However, in this thread you made several claims that the chip was running at 500GH/s and "way over 500GH/s". Can you please stay on topic and tell us more about the conditions used to get to these performance levels? If the chips are shipping soon, we'd like to know what we have to do to also see 500GH/s.

Actually at this point... getting your miner earlier is better than later since they were never going to honor the BTC refunds.  You can at least get started trying to dig out of the hole... but the MPP is where it really will matter and we still have no clarity on that yet.
