Ok, so let me get this straight.

A company says "we will offer you a full btc refund if we fail to ship" and you are saying I should not expect them to live up to that? Why should I expect something other than that which was advertised?

it depends WHEN to expect them to live up to that. i can see that you bought the BJs in expectation to trigger a BTC refund past 31. dec.

but i say its naive to expect them at this BTC to be able to buy back enough BTC to offer refunds for their batch#1 customers. those BTC are effectively gone.
advertised or not doesnt matter, no BTC is being sent from heaven for being advertised for sometime in summer.

So what is your position within the company to make statements on their behalf?

that COULD be an option, but i doubt that anyone will have their hands on those masks anytime soon. in summer/fall 2014 those masks wont be worth much imo. and that would mean that the court is REALLY fast. more realistic would be 2015 and then you can wipe **** with those masks.

Well, we actually don't know the reality.  They could have ordered more, less, earlier, later. But if a large percentage of Batch 1 asked the question directly, we might find out the facts. This would have great bearing on a reasonable solution.

maybe, but the MPP order was a pretty big one. 550 BJ means 500GHx4x550. thats alot, you dont double that amount just for fun.

I ordered from this company because of the full btc refund guarantee.

your reasoning doesnt matter. there are no BTCs to gather. and not enough $-funds to buy BTC at this price level. so no BTC refunds, if you like it or not.

They already said MPP chips were already ordered and were different than batch #2.

That is already pretty clear.

#1) Full BTC Refunds

Except that there are a number of people that paid in USD, including at least one guy in this thread that paid over $100,000 USD.  So, do you mean that people who paid the equivalent - at the date of sale - of BTC 60 for a BJ should be refunded BTC 60?  Or $700 x 60 = $42,000?  If so, I agree.  If not, then we have a division between people who paid USD and people who paid BTC. And it may be unrealistic.

#2) MPP Shipped with the BJ
We know they can't literally ship at the same time, but we can certainly - if we work together - obtain more information on their delivery schedules and make them a proposal.


#3) 800% MPP shipped before Feb 1

At this point, this is really the same question as #2.  I agree that both are possible solutions, we need to know more about what's happening behind the scenes.

you should start to realize, there are no BTCs to refund. those BTC got changed to $ and invested. nothing to gather here.

and what chips are to be used for this MPP shipment? no chips, no MPP. the next batch of chips will be from batch#2 customers. what do you propose here? do you think it would be fair to fuck batch#2 customers now, just that you can congratulate yourself to have taken the right decisions?

#3) 800% MPP shipped before Feb 1

same as 2.)

chips dont fall from trees, they have to be ordered and produced months in advance. so no such thing as "800% MPP shipped before Feb 1" to happen anytime soon.

We should also ask why their puppet pointed us to that eligius address in the first moment, it's in fact a strange address that is growing a lot - their goal is to have us to lose time, money and strenght over something useless, like the emails or if they are mining with our hardware or not.

Rather than each theorizing about what evil plot is in the making, if we instead focused on agreeing among ourselves about what corrective action should be taken...

They have created the mess they wanted, even in this thread. They are some first class devils. Crossposting a good post:

It is clear that HF can be very productive when its THEIR profit on the line.

There is a sick fascination for how efficiently they are minimizing their losses and maximizing ours. I fully expect that the growth of the eligius address to increase to ~285TH (a complete 550 Baby Jets + the 10TH they started off with).  I think the Rev2 board thing is a smoke screen... they just want to mine the crap out of the machines up until the very last moment of their deadline.  They are looking at >~125BTC a day at full strength, and I don't expect any of them being shipped early.

We should also ask why their puppet pointed us to that eligius address in the first moment, it's in fact a strange address that is growing a lot - their goal is to have us to lose time, money and strenght over something useless, like the emails or if they are mining with our hardware or not.

What needs to be discussed is:

1) EXWORK vs DELIVERED. I've still to hear back from my lawyer about this, and it is incredibly important. We can't just choose one option in a non rationale way.
2) More proofs of BTC refunds. Is ninjarobot ready to testify pro us in court what they said when he went to visit? Why jjiimm_64 can't share any info about it's mistery email (i asked him if he could share it with a mod).

do you really think they were mining now??  they can't even get anything to work and even if they did where the hell would they set them all up so fast to mine??
They said Rev 0 sucked and they now received Rev2 so it is safe to assume that Rev1 fixed some of the problem but not all.   I found it interesting in the other thread how unstable the miners were on whomever's Eligius account the person had posted.   I would appreciate HashFast coming out of stating categorically that the Eligius account posted by the member is NOT associated with HashFast nor their chips in any way and the timing (and apparent instability of the boards that are hashing) are coincidental.

I think that would put everyone at ease.
