Don't believe the FUD; the ToS are not in conflict with FTC regulations.

HashFast paid lawyers specializing in that sort of thing to write their ToS in accordance with all applicable laws, rules, regulations, etc.

There is no "right to cancel an order before the guaranteed delivery date" nor is there any FTC regulation creating one ex nihilo.

When You Must Cancel an Order

You must cancel an order and provide a prompt refund when:

And, you know what, they were talking about "BATCH 2"!.
So why they didn't quote the ToS when they reply the inquire?
Everyone saw this words, they will think about deliver on "Nov 15-30" or "March 2014",
if they told everyone about the real delivery date, would you place any order on it?
If you can, you will go for another supplyer for sure. You will not need read this long thread.

No, wrong.  You don't have the right to cancel an order before the guaranteed delivery date you agreed to in the ToS.

Since when do random ToS trump FTC regulations?

Well I will give them until this week as they said me:

I don't have an update right now, but I hope to have one this week.

If in this upcoming update they do not say the things clear, I am just going to take the lawyers way. And by clear I mean where the hell are the pcbs, the cases ( PHOTOs and videos testing, not NDA bullshit) and what happens with the chips.

They have just deleted their Ciara pictures blog entry and uploaded another entry with the SAME pictures where it says:

Here are recent photos taken on the assembly floor at Ciara, HashFast’s exclusive assembly house

Really, now I understand why the have the comments switched off on their webpage. A company that knows that is doing the things in the right way wont try to silence all its customers like HF is doing.
Now where are all the HFs people that were posting so much when they have to get the units sold ? Where are they now ?

So when it's panic time?

Actually, now they are 100/200px larger. It's our lovely John that is starting to understand how wordpress works. Hey John, in case you don't know, there is an edit feature in your control panel! Really!

Since when he decided so, if not, HF really has a problem. First open source 22nm for the win!

Crypto is the separation of Power and State.
Start by contacting as many lawyers as possible, than we will decide the best one for our case and we will pool the resources.

I think that it's not a good idea. Start by contacting as many lawyers as possible, than we will decide the best one for our case and we will pool the resources.
I know of at least 2 that have meetings with lawyers this week.

Hope that they will keep me updated, and that we will all go on together against this. As i said multiple times, my against-hashfast-lawyer-budget is 10k$ (i was stupid enough to make a big order).

Lets be clear, there were no guaranteed delivery dates. There were implied delivery dates of shipping batch 1 to start 20th October, batch 2 mid November.

Dates related to when a refund would be available if machines were not shipped.

Yes and it is against U.S. law to deny a refund if you haven't shipped an item when there are no guaranteed delivery dates.
Consumers have the right to cancel the order before they get the items purchased. Right?
So how to find a lawyer to against the HashSLOW?

Working on contacting different consumer lawyers in California.  You should too.
Also, make a complaint with the FTC
https://www.ftccomplaintassistant.gov/GettingStarted?NextQID=203&Url=%23%26panel1-6

Failfast had enough time to try to make things right.  They clearly don't want to.
I am in CA, too. Shall we have same lawyer to low down the cost, and for US LAW, if we win one case, all his consumers will have same situation.

Good luck finding a lawyer willing to touch the Bitcoin ASIC space with a ten-foot pole.

I'm *sure* you will have just as much success as the BFL class-action.  Oh wait, what BFL class-action?

You won't get anything but legalese talk about how you agreed on the 31 Dec date, and that they are in line with that date.

I speak fluent legalese.  It's my mother tongue.

This is plain English, not legalese:

Quote

3. DELIVERY AND QUANTITIES.
Guaranteed Baby Jet Delivery Dates – Batch 1.

All of the 550 Baby Jet units from Hashfast’s first production batch are guaranteed for delivery by December 31, 2013.

^^^This is a very simple sentence, easily comprehensible to even the thickest plank in the slow reader class.^^^

There is a subject (All of the 550 Baby Jet units from Hashfast’s first production batch) and a predicate (are guaranteed for delivery by December 31, 2013).

Nothing is ambiguous; no parsing is required.

How stupid must one be to believe that "All of the 550 Baby Jet units from Hashfast’s first production batch are guaranteed for delivery by December 31, 2013" is legalese?

It's not even written in a tiny font.  There is no excuse for such misrepresentation.  It's pure, fact-free FUD.

Who and how does it guarantee that delivery?
