Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.

Lol. It is impossible to happen to got some address with a coin loaded itself. First of all the new generated wallet is not from other people used wallet. If thats happen by chance. It is not stealing. Its just like founding a treasure.

Yes bro stealing someone's Bitcoins is still illegal because for stealing someone Bitcoins you need to hack the wallet of the guy and everyone knows hacking is illegal in every country if you use hacking for stealing a user info. Without his permission.....

Somebody buries his gold in the forest. You go to the forest at a different time, dig a hole and find the gold. Is it illegal for you to take it? I guess not. This example is similar.

If you have the keys... you own the Bitcoins.

From the statement that "stealing" of course its illegal Smiley But, when the generated address is the same address someone already owned? I think the probability is zero?  I dont know either but if it will happen, its not your fault. Smiley

I think any form of stealing is wrong, but whether it is illegal is really up to the law. Taking bitcoin from an address that you know the private key is not illegal. However, if it is known to belong to someone, it is better that you try to contact him/her and not just take it.

I think if that case happen then its your luck, because even though you want to return it you dont have any information, unless somebody can prove its his address then you can return it, but its all up to you

it's illegal from morality and religion's rules but i guess if it's about the government rules, maybe it's legal as you don't really steal it and the ones who makes this mistake is the sender, and there's no rules about this released by government,so it depend on which rules you follow

Any stealing act for anything to anyone is still illegal wether it is online pr not.All stealing avt is considered a crime as long as you dont have permissions of the real owner

yeah I agree. we're not allowed to take something without the owner's permission. just imagine if other people steal something from you. it should be bad for you. so if I were you, I wouldn't steal anything.

steal , no matter what stuff you stole is illegal . Make others lose because of your actions is not recommended . Similarly with bitcoin . Stealing bitcoin from others is of course illegal. So, dont do it!

It could never happen in your entire lifetime so don't worry about it. Now if you intentionally stole some bitcoins by hacking someone's computer or stealing a phone then yes it's illegal.

If you managed to get the same private key as someone else that did have some Bitcoin in it, you would be able to steal it and not break any laws, but if it is a big enough amount you might have to worry about more than someone just being mad on the other side of a screen. Some people would have a lot of other assets that they could use to go after you in real life, so just keep that in mind.

But due to the relative unregulation of Bitcoin, stealing Bitcoin is not illegal in a definitive and specific sense.

I would hope so  Shocked
After all bitcoin is equal to money. Cause what if someone who ran a ponzi scheme and took in 250 BTC from people. Would that not be seen as a crime? That is theft I would say for sure and maybe even a conviction of fraud directed towards the investors of that scheme.

By moral, it is of course illegal but there aren't any written laws yet that prohibits us from doing so, I think.

However, the chances of that happening is nigh-impossible so we don't actually have to worry about that happening.

Yes, morally and legally it's stealing.  But as mentioned, for practical purposes, the universe will have collapsed in on itself and big banged its way into existence over and over again a zillion times before it happens.  But hey, good luck to you.  Let us know how it turns out.
