Alright BA, I am going out to lunch soon, please wait until I get back to post your update as I would love to hear (and secretly be apart of) the HUGE backlash your about to receive.

Please also include a short statement as to why you will not bet me that you will ship a completed product on May 1st, certainly you will know that you will 1) Either ship that day and make the easiest $250 ever (even easier than opening a product for preorder with a deadline you know you wont hit) or 2) you know you won't hit the deadline but have not told us because your afraid of the backlash that will ensue.
I think at this point we don't have to worry about any "professional" "ethics" disputes about betting on when you'll ship, for that ship has sailed long ago, so please let me know if #1 or #2 is what is currently happening.

I have asked for a refund but i'm batch2 with minersource, and since batch2 ain't delayed just yet i'm shit out of luck.


as per the FTC  http://www.usa.gov/topics/consumer/smart-shopping/home-shopping/rights.shtml

"When you order something by mail, phone, fax or computer, the Federal Trade Commission requires the company to:

Ship the merchandise within the time promised, or if no specific delivery time was stated, within 30 days of receiving your order.

Notify you if the shipment cannot be made on time and give you the choice of waiting longer or getting a refund.

Cancel your order and return your payment if the new shipping date cannot be met, unless you agree to another delay.

If you cancel, your money must be refunded within 7 days (or your account must be credited within one billing cycle if you charged the order). The company can't substitute a credit for other merchandise. If you applied for a charge account with the merchant at the same time that you placed your order, the company has an extra 20 days to ship the merchandise to allow time for processing your application."






So I'd say the claim that your order is non refundable as of yet is a violation of consumer law. 

If they argue that delivery was firm at April 30, you can go to the BBB or wait another 6 days and cancel May 1.  If they say April 30 was not firm then they only have 30 days to ship your order, which obviously has not happened. 
 
Either way, you can get your money back May 1 when the UPS man fails to show up- and they are obligated to refund within 7 days, with or without a fully migrated database.

Here is the message that I received from David about my offer to bet him.  I would say from this response that their is new information we are not privy to yet, that their will be additional delays.  He can argue all he wants that it is, "unprofessional" to make a wager like this, but in reality, it should be the easiest $250 dollars he ever made, if they are on schedule, the fact that he will not take the bet is pure indication that it is widely known that the new shipping date will not be met.  Plus, why would they choose now to start acting professionally?

I also would believe that once BA received chips their would be a special update saying that they had received them, including pictures and the like.  There has been no such update although if I remember correctly, the chips should have been received by now?  Time to get in for refunds is slowly dwindling and I urge everyone to please consider going for a refund immediately.

Yeah, it's ridiculous that BA haven't given a definitive statement on whether they are shipping or not. Either the miners are ready to go into boxes or not, it's not that hard to figure out then inform customers.

How likely is it that a couple of million dollars worth of orders will be shipped now? I say completely unlikely.

It's very difficult to see BA's conduct as anything less than atrocious.

What about when we open a ticket asking about a refund and then you close the ticket with no response?  Should we just assume you don't give a fuck about your customers or open another ticket?  At this point, I don't know if miners are going to show up at my door or if I'll receive a refund or what...

I really doubt I will trust again any firm regarding pre-ordering products that are not already created ... My experience with BA / Minersource is at this point considered as "very bad", and I hope it won't get to "worse than very bad" ...

Anyway, I have learned the lesson the hard way.

Currently, I am not even thinking on ROI, but at least to get the products I ordered, but thinking also on a legal suite that might be done by lawyers. The entire situation is just inacceptable and highly unprofessional. I did manage IT Services in several banks, and we never had such situation with providers.




Completely agree. Anyone with any corporate experience knows that there are major problems with BA at almost every level of their organisation.

You ordered from Minersource and not BA directly?  Because they aren't importing orders from BA's site.
I order from Minersource directly. Wouldn't be surprised if next they claim I never ordered from them to begin with and try to steal my money.

Still expecting to see my orders from December (batch 1) on the created account by MinerSource ... We are at 8 days of shipping, and no trace of my orders... This is REALLY annoying and not funny anymore.

Lol, my order was from the very first site. It was never imported to the second site and they're claiming that all orders have been imported into the third (current) site but I still don't see anything. Worst customer experience in the world..

This is slightly off topic but I wanted to order an X-1 from minersouce.net however.  Am I the only one that noticed they do not offer an SSL connection.  It is only http.  Is there another vendor that is security conscious for their consumers. 
You don't need to create an account, our checkout page has a SSL certificate on it which is where all the customer information is captured.

Smiley I am simply asking them to decide if they can ship on time.  If they are realistically going to hit this goal then it should not be a problem for them to accept this offer immediately, if they do not answer or refuse, then it is only safe to assume that they have no expectation to hit the May 1st shipping date.
