Screw the Police.  

I don't mind being Dox'd because I haven't done anything wrong, save for being dumb enough to put too much faith in everyone and giving them the benefit of the doubt.  But I refuse to change my ways due to the fact that this attitude is more powerful that simply thinking you're smart enough to avoid the scams.

Let me tell you a Story,

Once upon a time; there was a dumb 27 year old Florida Gators fan that went nuts during their haydays, and always went out drinking when his team played important in conference, or rivalry games.  

Well, one time, this person drove home drunk and paid the price with a DUI

5 years later, this same person decided to google his own name and was shocked to see that there were scam artists JUST LIKE the owners of PB mining; that wrote simple powershell scripts to scrape mugshot photos from police websites, and then indexed them on google (where the police websites were protected from the search spiders by bot scripts).  

In fear, This now 32 year old paid $400 to have his mugshot taken down, in fear that someone in his job would see it, possibly affecting his career.  

Upon paying this $400, the image was IMEDIATELY removed; when the site said it would hire a crack team of lawyers to remove the image.  Now, this person may make dumb decisions, but he knows enough to know that a legitimate legal process takes more than 5 mins.

So he started doing some research and was SHOCKED to find out that kids as young as 14 years old were being subjected to this humiliation, and the potential destruction of any job prospects if nothing was done.

So, this person decided to put his contacts into motion.

Bottom Line is, these scammers don't fear the law.... They fear AWARENESS.  I am a platnium member of the Electronic Fronteir Foundation:  I have a great job and have plenty of money to play with... I don't play dirty, But I play hard.  

So, PBmining... I don't mind being Dox'd as I don't care what people know about me; as long as I'm trying to do the right thing and help other people who have been wronged in the same way I have.  How many kids signed up for your service?  did you do enough to verify their age?  How many elderly people did you swindle out of their savings.

Anarchy is not chaos.
If it was a case of disagreement with a shop, then yes it would be a civil matter. However in this situation the shop has a disagreement will all of its customers and that changes things. Because of the potential size of this and the way it appears to have been structured, there is a much larger set of legal remedies available and potentially criminal too.

The criminal element would be, if it can be proven Boyko knowingly setup a ponzi scheme with the deliberate intention of defrauding the people that invested in it.

That is a common element of the law in many countries, I cannot see it being markedly different in Canada.

Other than that, it appears to be a case of a business, a company failure and as such normal receivership and liquidation under company law would apply.
There are likely to be legal remedies and charges that could be laid against Boyko under Canadian Company Law which could see Boyko being banned as a director and fined and if the offending is deemed severe enough there may potentially be more significant punishments.

This is all pie in the sky at the moment ... Yes, something has gone terribly wrong inside PB mining and we the customers are bearing the brunt of it with the possibility looming of total failure and complete loss. But there is a way to go before we get to that stage.

People can yell and scream as much as they want, but there is a set legal process and procedure that will need to be followed and adhered too to bring the company and it's directors to justice. Baying for blood and making threats is not going to help matters or speed them up.

It appears several approaches to authorities in Canada have been made. Those must now be left to investigate and decide on what actions are appropriate. As much as it sucks, all we can do is wait and see what happens.
I'm in the USA, so this MAY not apply, but corporate structure is very similar between the two countries. Basically, as you said, it comes down to two things.

First, if he was running a ponzi, then it is definitely a criminal matter. Proving that will be interesting.

Second, he was actually purchasing and reselling hash power and something went badly wrong in his supply chain. That's a civil matter, and not criminally actionable unless it can be proven that the failure was intentional. In that case, he has options. One, the one he's claiming. Try to rebuild through other avenues and compensate the existing customers accordingly. Two, bankruptcy, in which case said customers can make a claim and hope that they get a piece in the settlement. Simple bankruptcy due to business failure will not bar him from trying again or doing a different business, but it will affect his credit, or that of the corporation depending on how it's structured.

I hate agreeing with Puppet, because he's abrasive, but he's been right too many times for me to ignore it. If he's right, then we all got caught in a ponzi. I didn't think so at first, because the rate and timing of them adding new hash was consistent with them buying equipment from Bitmain and ASICminer. The delivery times and amount of hashpower corresponded. Later, it seemed more hash, faster, but there were a lot more hardware options then. I also was under the impression from private correspondence with pbmining that they were reselling only a portion of the hashpower they purchased, so that they always had a slush fund against power costs and to make a bit more profit off of their own mining operations. That would have been a sustainable model even given the no fee contract. It's the way I would do it if I had the capital to get it started.

At this point, I guess we wait and see. Not much else to be done, except those who have not broken even might have legal avenues to pursue. I liked the guys in private correspondence, they were always cordial and the reasons for their secrecy seemed legit to me. They had said that when they were just resellers of ASIC equipment that people had broken into their facilities and made personal threats, and they were not equipped to deal with that. Given the level of crazy on these forums and in this industry, I found that reasonable. But they've gotten very large, and I think this no longer applies, and said so many times. With the sheer amount of business they've done, they could afford very good private security were that still the case. Something stinks like rotten fish.

EDIT: I have apparently remembered incorrectly, in looking through previous correspondence I cannot find anything about a break-in. PBmining asked me to document this conversation just a few minutes ago, and I can't find it. I did find one about being harassed and threatened, so I'm leaving that as is. I either remembered wrong or deleted a PM, but I rarely delete PM's so we're going with old age on this one.

If PB miners were a complete scam then he would not have come back on to the forum to show his face. I just hope that he sorts us all out. Even if he just backpays what we have lost and then carrys on with my weekly payments I would be happy.

I do feel though PB that a lot of people do want transparency and because you have not explained what completely has gone on this has cheesed a lot of people off. To not be told what is happening with our contracts and mine of 900 gh/s I just want to know what's going to happen with the recovery program that's all I want to know :-)

This is an easy way to buy time to clear out completely. Either that or they will offer a settlement which will be accepted by the customers, thus freeing them from all liabilities. Its better to take 10% and not be in any danger of legal trouble rather than try to flee with 100%

He only came back because his real identity was revealed, which means he fears the police/lawyers getting involved. Without that revealed you can bet your last satoshi he'd be long gone.

I just registered on this site because of the pbmining situation, and because it's hard as hell to register through TOR. Had to set up my own exit node.  

I have almost 4000Ghz invested, so the notion that "those who sustained substantial losses" will be taken care of first... I find this false.

My username here is the same on pbmining, I had it hidden but I'll uncheck the box to show that I'm near the top in GHz invested.  I started in September / October.. so yea.. my losses are pretty damn substantial.

I have received no communication, no refund to my BTC address.. Nothing.  

I'll be sure to post back and apologize if PB mining makes good on their promise... but so far all I get is automated email responses that they're a failing business blah blah blah.

I would happily take back my harsh criticism if the promises are made good on, because in this day in age; money is much more valuable that pride.  But until then... NEVER do business or believe a single word from these scam artists.  I was dumb enough to have be had, but I'm not dumb enough to get strung along.  Not that 8 grand is going to bankrupt me... it's the principle. And if you don't thing I have the resources to hire lawyers and investigators to dig you out of whatever hole in whatever country you're hiding in, whether or not Boyko is your real name or not; you're sorely mistaken.  Iceland? lol   c'mon.  I go there for museums built in volcanic ash.. not for data centers .
