Yes. But for the soft fork, the DAO holders can use the DAO not yet stolen. They will lose about 3.6 million coins.

Yes, with soft fork all investors lose 3.6 million eth. If the attacker doesnt decide to drain all that is left, what he can still do since nothing has been done to prevent this.
He gets nothing, investors in the DAO lose over 11 million ETH + the price drop of ETH that allready happened becouse of this attack. So the attacker will not get anything, but he made people lose over 1 billion $.

Hard fork is only way to make this right. Attacker will get 0, people will be refunded.

I think the best would be to soft fork and burn all ETH locking them in the contracts forever after this desaster and ETH price declining. I also invested in DAO, but still.
ETH would be more scarce and every ETH holder gets more worth.
Of course then anyone, who invested all his money in DAO and didn't keep ETH is fucked, but honestly... I don't think anyone should have done that...

yes they invest more than what they willing to lose.
i dont invest in DAO either, and i do prefer burning the eth.  however i think  returning those eth will be more morally correct atm, and should be do able without hardfork if my idea is doable.

The contract law could indicate a contract should be fair to both parties. If the law thinks it is unfair, then the contract is invalid.
Smart contracts are computer protocols that facilitate, verify, or enforce the negotiation or performance of a contract. How will you prove that ethereum computer protocol is unfair? How will you prove open source computer code that calculates 2+2=4 is unfair?

Guys, is there a possibility to move Ethereum address to another wallet? Something like in a QT-Wallet where you can export private keys and import them into new wallet.

The original Ethereum wallet was on 64bit Windows PC which was not mine (company owned) and I have 32bit Windows. Do you think that this could be some problem too?
