Why? If you feel they have defaulted on a contract, file a small claims court action. If you're not in Kansas, let them pay 6 grand for an attorney to represent them. If they don't, you win. You get a judgment filed against them.

It's not the same as getting your money, unless you subsequently agree to satisfy the judgment in return for a refund...
