Anyway... Someone with a PACER login who's willing to check out the docket on Bevand v. BF Labs Inc. et al. RE: "Racketeer Influenced and Corrupt Organizations" and reporting here about it, would be highly appreciated...

Please see https://bitcointalksearch.org/topic/butterflylabs-huge-scam-114329

Yup. saw it. Thanks! I expect quite a few "additional parties" will be requesting to "join"...  Grin

[...]It doesn't matter because they are completely gone, all their assets seized and the business closed. See this document: https://www.ftc.gov/system/files/documents/cases/140923utterflylabstro.pdf

Nope, that is "only" a temporary receivership order, and was lifted after the case was investigated and a settlement was agreed upon...

A case brought against them at this point would be like me trying to sue Montgomery Ward or Mervyn's. [img]

I'm not that well versed in USA law, but "here" in Europe a case concerning "Racketeer Influenced and Corrupt Organizations" would certainly go even beyond a possible bankruptcy and directly onto the principals (as private persons).

As far as I can see "the fat lady has not sung yet"...  Grin

I wish you were right. There should be some sort of "public raping with a baseball bat" reserved for the worst abusers of people.  Unfortunately, that's not the case. They are gone and closed. A while ago I called Kennel Creek pet resort and daycare next door to their office and asked if they would mind delivering an urgent message to them. (Very nice lady btw. I would use her daycare for my dog if I lived in the area.) She told me they were completely closed up. She could see through the window and they were cleaned out.

I don't believe there is any criminal way to punish the principals now but keep a happy thought. I doubt they are still even around to be prosecuted. They were stupid but I doubt they are that stupid unless they were told by their attorney that they could take no personal responsibility and it would all fall on the company. They are all probably very far away at this point.

I just noticed a "new" lawsuit against BFL (and its principals) at: JUSTIA Dockets and Filings: Bevand v. BF Labs Inc. et al.

The "Nature of Suit: Racketeer Influenced and Corrupt Organizations" sounds interesting enough...  Grin

Anyone still around with a PACER login to check out the full docket?

Is bfl still a thing?
no one can be buying their shit still, can they?
Yes, "they" can (it they're "institutional buyers": at their website...)!  Grin
You forgot pawn shops and flea markets. Oh, and the used trash section of eBay.

Oh, oh, oh! Wait! You forgot the auctioning off of office furniture/equipment on Craigslist...  Grin

Yep, I've made more money buying and reselling used BFL equipment than I have holding Bitcoin. lol

As far as I'm concerned, BFL was the worlds first discount ASIC manufacturer.

Yeah this is pretty spot on lol. I`m with you on this.

I made more money selling mining gear back in the day esp when those 5gh jalpenos were some huge thing one listing alone if I remember correctly was like $1k.

then the other models came out and the typical pre-order nonsense lol.

[...]The only legit way to buy a miner is through a contact or physically buying on from the country the seller is from meeting face to face. If you going to sink that much money into mining do it right. Dont take silly risks.

I don't agree; I have ordered several (generations of) miners from Bitmain and I must say they have always delivered: on time, at the announced price and according to advertised specifications.

PS I actually got banned from the BFL Forum making this exact point/comparison.

Continuing where we left off at https://bitcointalksearch.org/topic/m.11069878

Looking at BFL past record from hmmm like 4 years ago we should all know by now they can't be trusted. If you still fooled after 4 years its your own fault. The only legit way to buy a miner is through a contact or physically buying on from the country the seller is from meeting face to face. If you going to sink that much money into mining do it right. Our government is just really, really slow to do anything. Example: I was audited by the Irs. They notified me that I was being audited. I had 8 months to submit paperwork in my defense (I took all 8 months to do it). They spent almost a year reviewing my submissions. They fined me a couple grand and I contested it. That took six months. I lost again and they billed me giving me 12 months to pay.  I never did pay anything because I submitted "an offer in compromise" which took another year for them to review and it was accepted. It was finally over about 5 years after it started, they made no money but did spend money on the wasted man hours. The US government is so absurdly fucked.

So long as they caused a similar amount of time and trouble to you they are probably satisfied with that result.  Alot of the government is to just redistribute wealth, the obvious argument that government is not doing anything useful alot of the time is probably a no contest for them.  IRS audit is a big scaremongering deal to effect an influence on people who might otherwise think of paying less tax or even question why they are paying 50% of income in some cases

Very true, and it works most of the time.

A question for someone knowledgeable/experienced with USA's court proceeding:

Why isn't the case docket still updated with the final documentation? The settlement has been agreed upon a couple of months ago, but the latest upload date in the docket is still at "2015-11-11 20:44:51"...? I can read the most recent (last updated: February 18, 2016) FTC docs here. But still, these are "just" proposed orders...

Ah thanks,

So it's normal "there" too (I just - this month - paid off my Dutch IRS equivalent tax audit for 2011).

OK, let's "wait and see"...  Grin
