Uh oh: Did latest CMP video show confession of lawbreaking in Minnesota?



In an unexpected development, the video released from the Center for Medical Progress on Tuesday may land both Planned Parenthood and Advanced Bioscience Resources (ABR) in legal hot water. ABR procurement manager Perrin Larton told CMP investigators that they work with clinics in several states (starting at 4:35 in the video), including in Minnesota. There’s only one problem with that — fetal tissue donation is illegal in all instances in Minnesota, whether compensated or not, as LifeSiteNews reports:


Somebody in the abortion industry is breaking a Minnesota law that bans the sale or donation of aborted babies’ body parts.

That’s the conclusion of numerous elected officials, who are renewing calls to investigate Planned Parenthood in the wake of undercover videos about the harvesting and sale of fetal organs and tissue.

Dozens of Republican state legislators asked Democratic Gov. Mark Dayton to investigate the abortion provider after the Center for Medical Progress released videos detailing the little-known practice. The sale or donation of fetal organs or tissue is illegal under state law.



Just from a cultural standpoint, that’s a curious anomaly. This is a liberal state, as conservative Minnesotans such as myself are constantly reminded, and also a state with a significant amount of medical research taking place. We have a large medical-device manufacturing sector in Minnesota as well, plus a number of universities at which top-flight, cutting-edge services are offered. Minnesota manages to do all that without allowing fetal tissue to be harvested. Hmmmmm.

LifeSiteNews links to the law covering the disposition of fetal remains, whether from abortion or miscarriage, Section 145.1621. The law only allows remains to be disposed through “cremation, interment by burial, or in a manner directed by the commissioner of health,” the latter option applying only when the first two are somehow impossible. If that isn’t clear enough, subdivision 4 also states that tests can be performed on the remains only to “complete laboratory tests necessary for the health of the woman or her future offspring or for purposes of a criminal investigation or determination of parentage[.]”

A month ago, the regional Planned Parenthood affiliate in Minnesota and the Dakotas (PPMNS) insisted that they do not participate in fetal organ harvesting. In response to a letter from a state legislator, PPMNS CEO Sarah Stoez flatly denied working with procurement companies like ABR. Governor Mark Dayton called it a fishing expedition and refused to authorize an investigation, and Lt. Gov Tina Smith publicly supported her former colleagues at PPMNS.

This admission, however, puts Dayton and Smith on the spot. LifeSiteNews did some digging and found out that ABR has been registered as a non-profit in Minnesota since 2009, and at least one of their former Minnesota employees lists herself as a former procurement specialist on LinkedIn. So what was ABR doing in Minnesota? House Speaker Kurt Daudt (R) wants to know that, too. He’s calling for an investigation — again — to find out what ABR’s doing in a state where fetal tissue donations are illegal, and who their suppliers here might be. There are other abortion clinics besides PPMNS, but it seems unlikely that they would open an office in Minnesota just to work with one or two clinics in the region.

In other news, Wisconsin legislators want their state out of the fetal organ-harvesting business, too:


About $7.5 million in federal funding for Planned Parenthood in Wisconsin would be cut under two Republican-backed bills heard Wednesday by a state Assembly committee, measures that come as the Legislature also considers criminalizing research on aborted fetal tissue.

Supporters defended the measures as reasonable steps to prevent taxpayer money going to a group that provides abortions. But opponents said halting the funding would adversely affect the women’s health services, including cancer screenings and wellness checks, which Planned Parenthood also provides to about 60,000 men and women a year.

Gov. Scott Walker — who has been touting the fact he cut state funding to Planned Parenthood on the presidential campaign trail — has said he supports efforts to curtail federal funding as well.



It’s not a slam-dunk on criminalizing organ harvesting; one Republican state senator objects that it would impede work at the University of Wisconsin. It doesn’t appear to slow down work in Minnesota, though, so perhaps Sen. Alberta Darling should take a hint from their more liberal neighbors to the West.

New CMP video: Sometimes babies just “fall out”


The latest video from the Center for Medical Progress takes viewers on the inside of a tissue-procurement competition between for-profit StemExpress and not-for-profit Advanced Bioscience Resources (ABR), Inc. Two discussions with undercover investigators demonstrates why the relationship with StemExpress undermines Planned Parenthood’s claims that they do not profit from organ harvesting in their clinics, but it also raises a question about live births from abortions. At one point, ABR procurement manager Perrin Larton describes how some abortions from mothers produce actual births — and the implication is that the babies then become intact cadaver specimens:




“The whole point is not to have a live birth,” Larton says. “Unless it’s somebody who has had six pregnancies and six vaginal deliveries.” The undercover investigator asks, “And then it just pops out?” “Yeah,” Lartonreplies, “they put lams in and she comes in the next morning, and I literally have had women come in, and they’ll go into the OR, and they’re back out it in three minutes. And I’m going, ‘What’s going on?’ ‘Oh yeah, the fetus was already in the vaginal canal. Whenever we put her in the stirrups, it just fell out.'”

“Lams” are laminaria, which are used to dilate a cervix overnight for two-stage abortions. They are used when overnight dilation is necessary to remove a larger fetus, but they do not cause the abortion itself or kill the fetus on its own. That requires the surgical abortion, which takes place after the overnight dilation. Small wonder some babies just fall out, but if they do, they may well be alive. Stacy doesn’t say what happens to the babies after that point. Are they kept alive, or are they killed to complete the abortion?

That has echoes of Kermit Gosnell’s clinic, and Larton even jokes about Gosnell in passing just before this exchange.

The larger point, though, is that the difference between ABR and StemExpress is that the latter pay money back to the clinics. StemExpress CEO Cate Dyer can’t grasp why any clinic would choose to work with ABR when they can get a revenue stream from StemExpress:


Cate Dyer, who used to work as a procurement technician for ABR before founding her own company StemExpress, shares some of the financial details of ABR: “They were funding places in Hawaii for themselves,” she divulges. “Some staff–not that I know so much on the Planned Parenthood side, but I wouldn’t be surprised–there are some staff in the past that have been on the payroll with ABR.” According to Dyer, ABR would pay an “advisor fee” to a clinic manager or director in order to preserve their exclusive right to harvest fetal tissue at that location. “There’s like, well enough known,” says Dyer, that “for a long time there were certain clinics that because they had paid advisors that were sitting on boards for these clinics, that were also an advisor to ABR, you were just never going to go anywhere with them, you know what I mean?”


Dyer makes the point more obvious later in the video. “I’m like, ‘So I want to pay you, she doesn’t want to.’ And I’m thinking, I’m like, ‘We’re trying to give money to you.'” Dyer emphasizes that ABR doesn’t “pay the clinics,” but StemExpress does, and wants to contribute to their bottom line.

It’s what the market will bear, right?

Update: Jeryl Bier noticed yesterday that StemExpress has deleted references to “financial profits” for clinics from its website.

Networks Ignore Timely Margaret Sanger Protest at National Portrait Gallery



Not even in the wake of the sickening Planned Parenthood videos will the broadcast networks dare to criticize Planned Parenthood founder Margaret Sanger.

During their news shows, ABC, NBC and CBS ignored a press conference against Margaret Sanger held in Washington, D.C. on Thursday. During the event, black pastors and other pro-life leaders demanded the removal of a Margaret Sanger bust – a bust they called “revisionist propaganda” – from a Struggle for Justice exhibit inside the Smithsonian’s National Portrait Gallery. Likewise, the networks censored tens of thousands of Americans protesting Planned Parenthood last weekend.

Organized by STAND and ForAmerica, the press conference concluded when speakers met with the art gallery’s head of communications, Bethany Bentley, and handed her their petition with more than 14,000 signatures against the bust.

There are no graphic images in the video, but Dyer’s comments about shipping the severed intact “calvarium” or skull of an aborted baby are bonechilling.

StemExpress: It’s almost like they don’t want to know where it comes from. I can see that. Where they’re like, “We need limbs, but no hands and feet need to be attached.” […] They want you to take it all off, like, “Make it so that we don’t know what it is.”

Buyer: Yeah. Bone the chicken for me and then I’ll eat it.

StemExpress is a for-profit biotech supply company that has been partnered with Planned Parenthood clinics across the country to purchase human fetal parts since its founding in 2010. StemExpress’ Medical Director, Dr. Ronald Berman, is an abortion doctor for Planned Parenthood Mar Monte.

In the video, actors posing as another human biologics company meet with StemExpress CEO Cate Dyer, plus Vice President of Corporate Development and Legal Affairs Kevin Cooksy, and Procurement Manager Megan Barr. StemExpress and the actors are discussing a potential partnership to supply extra fetal body parts to each other.

“So many physicians are like, ‘Oh I can totally procure tissue,’ and they can’t,” expresses Dyer, seeming to indicate that abortion doctors must do the procedure in a special way to obtain useable fetal parts. Federal law requires that no alteration in the timing or method of abortion be done for the purposes of fetal tissue collection (42 U.S.C. 289g-1).

“What about intact specimens?” asks one of the actors. “Oh yeah, I mean if you have intact cases, which we’ve done a lot, we sometimes ship those back to our lab in its entirety,” replies Dyer. “Case” is the clinical term for an abortion procedure. An “intact case” refers to an intact abortion with a whole fetus. “The entire case?” asks an actor. “Yeah, yeah,” says Dyer. “The procurement for us, I mean it can go really sideways, depending on the facility, and then our samples are destroyed,” she explains past botched fetal dissections, “so we started bringing them back even to manage it from a procurement expert standpoint.”

Feticidal chemicals like digoxin cannot be used to kill the fetus in a tissue procurement case, so a fetus delivered intact for organ harvesting is likely to be a born-alive infant.

“What would make your lab happy?” asks one of the actors. “Another 50 livers a week,” says Dyer. “We’re working with almost like triple digit number clinics,” Dyer explains, “and we still need more.” She later notes, “Planned Parenthood has volume, because they are a volume institution.”

Dyer also agrees that payments to abortion clinics for fetal body parts should be financially beneficial to them. “Do you feel like there are clinics out there that have been burned, that feel like they’re doing all this work for research and it hasn’t been profitable for them?” she asks. “I haven’t seen that.” StemExpress publishes a flyer for Planned Parenthood clinics that promises “Financial Profits” and “fiscal rewards” for clinics that supply aborted fetal tissue. The sale or purchase of human fetal tissue is a federal felony punishable by up to 10 years in prison or a fine of up to $500,000 (42 U.S.C. 289g-2). The Sacramento Business Journal reported in June that StemExpress has an annual revenue of $4.5 million.

The video is the eighth released by The Center for Medical Progress in its investigative journalism study of Planned Parenthood’s sale of aborted baby parts. “StemExpress is the ‘weakest link’ that unravels Planned Parenthood’s baby parts chain–they readily admit the profit-motive that Planned Parenthood and their proxies have in supplying aborted baby parts,” notes David Daleiden, Project Lead for CMP. “Congress and law enforcement should immediately seize all fetal tissue files from StemExpress and all communications and contracts with Planned Parenthood. The evidence that Planned Parenthood profits from the sale of aborted baby parts is now overwhelming, and not one more dime of taxpayer money should go to their corrupt and fraudulent criminal enterprise.”

PLANNED PARENTHOOD’S BODY COUNT UNDER CECILE RICHARDS IS UP TO HALF A HOLOCAUST






You don’t have to be religious to be disgusted by the Planned Parenthood videos, nor about the media blackout from liberals about all of the most appalling details. Fortunately, an injunction was just lifted allowing even more damning material to come to light.


A broad chorus has come out against Planned Parenthood, with the hastag #ProtestPP currently trending on Twitter, primarily made up of Republicans — to no one’s surprise. But there are Democrats questioning things as well. For example, presidential candidate Hillary Clinton has called the videos “troubling.” So that’s something.

Incredibly, Planned Parenthood does not appear to be in any immediate danger of being defunded. Financially speaking, the organisation is stable. Planned Parenthood receives more than $500 million in federal funding, enjoyed excess revenues over expenses of $90 million in 2014, and has more than $1 billion in assets.

Of course, David Daleiden’s videos have produced hiccups. Corporate donors have demanded their names be removed from the Planned Parenthood website. Who knew that having your customers imagine an exhausted abortion doctor enjoying an ice cold Coca-Cola at the end of a busy day extinguishing lives might not be an effective marketing strategy?

Abortion is the business model of Planned Parenthood, and business is booming. Looking at the period of 2000 to 2013, government funding increased from just over $200 million to the aforementioned $500 million, while abortions rose 66 per cent and adoption referrals dropped 25 per cent.

More importantly, Planned Parenthood is gaining market share at a strong clip. In 1986, it accounted for about 6 per cent of the abortions in the United States. That has grown to more than 30 per cent as of 2011. This type of growth makes Planned Parenthood the Apple Corp of the Valley of Death.

Planned Parenthood can attribute a good portion of their boffo baby-killing business to their president since 2006, Cecile Richards. Richards is well on her way to personally matching Hitler’s body count. Breitbart has done the grim maths so you don’t have to.

Using a conservative estimate of 300,000 abortions a year — or 300 kiloscrapes, using the technical metric measure — Cecile Richards has presided over three million abortions, or three megascrapes in her ten years as president of the organisation. This has earned her “half Holocaust” status. Full Holocaust seems eminently reachable given Planned Parenthood’s growing hegemony in the abortion industry.

To be clear, this is just since Richards took charge. Planned Parenthood has since 1970 performed 7 million abortions, comfortably surpassing Hitler according to its own annual reports. You have to admire the chutzpah, if you’ll forgive my terminology: Planned Parenthood has amassed a Third Reich-style death count completely legally and while pocketing half a billion dollars a year to do so.

But under Richards the numbers have skyrocketed such that in just the last ten years, at least 3 million young lives were ended. If Cecile stays in her post another decade, she will reach “full Hitler,” by matching the six million deaths of the Holocaust. In fact it’ll probably be sooner than that, given the acceleration during her reign.

The road ahead may be rocky. Besides the undercover videos still being released, some media sources are starting to cover the revolting practices of these sociopathic monsters. Nice normal people, whatever their views on abortion, have no stomach for these unashamed charnel-house activities.

The liberal media, of course, can’t see the problem. One Slate writer considers abortion an altruistic act. And the Internet is full of misguided leftists like abortion counsellor Emily Letts, who posted a gruesome abortion diary in which she smiles and holds hands with nurses during the procedure. She wrote: “I don’t feel sad. I feel in awe of the fact that I can make a baby. I can make a life.”

She forgot to mention the last step: I can casually end that life, too.

Letts’s reaction may seem bewildering, but it is right in line with the beliefs of Planned Parenthood founder Margaret Sanger, who once said: “The most merciful thing that the large family does to one of its infant members is to kill it.”

And then, of course, there are the notoriously racially-charged objectives of Planned Parenthood. Presidential candidate Dr. Ben Carson recently pointed out that Planned Parenthood has a goal of controlling the black population.

There are many comparisons to be made here. Some of the revelations coming out about Planned Parenthood remind us of the ghoulish experiments of Dr. Mengele and the odious Unit 731 in Japan, both of which performed terrible tests on living subjects in the name of furthering medical science.

But for now we can say this: in a lineup of history’s biggest killers, Cecile Richards is currently in the middle of the list behind Japan’s Togo. If she can just keep up the fine job she is doing, she will quickly enter much more exclusive company in infamy.

Since Planned Parenthood was caught by the Center for Medical Progress by undercover video haggling over the price of human organs and discussing how to alter the abortions they perform to get "whole specimens" (or babies born alive) Planned Parenthood has been having some pretty bad days. Megan Fox attended the August 22, 2015 Planned Parenthood Protest to stand up for the rights of babies not to be butchered and sold for parts.

During the protest Planned Parenthood started piping in creepy horror/murder music over the protest. It doesn't take a genius to figure out that's their idea of a joke. Instead of driving people away it only solidifies the bad opinion of this rogue organization that is illegally profiting from the sale of human organs and laughing about it. They are flouting the law and now poking fun of what they do....kill babies and ghoulishly tear them into pieces for the highest bidders. There's nothing funny about killing babies for profit. Satan worshipers drown women with milk in Planned Parenthood counter-protest







Satan worshipers launched a counter-protest against pro-lifers outside the Detriot and Ferndale, Michigan Planned Parenthood locations Saturday.

Clad in black robes, members of the Satanic Temple of Detriot drenched bound women with milk, simulating water-boarding to "illustrate the theocratic agenda imposed upon female bodies." The milk symbolized breast milk, one of the protest organizers explained on Facebook.

The group attached a symbol of their temple to the American flag and held up a sign that read, "America is not a theocracy. End forced motherhood."

At one point during the protest, a man claiming to be a sheriff unsuccessfully attempted to move the Satan worshippers along.

Members of the Satanic Temple drew inspiration for their "political theatre" from the nationwide anti-Planned Parenthood protests Saturday. Tens of thousands showed up to protest Planned Parenthood at over 300 locations across the country after a series of undercover videos revealed the abortion giant was harvesting and selling fetal organs and tissue.

The pro-life protesters hope to end Federal taxpayer funding of Planned Parenthood, which currently receives over half a billion dollars per year. Michigan state senators, some of whom appeared at the protests Saturday, have launched their own bill to defund the organization.

"The Satanic Temple strongly opposes the promotion of misinformation and believes that all people are entitled to make informed decisions about their health, family and future without coercion," says the group's web site. "We consider our action a form of worship; the rejection of tyranny is an affirmation of selfhood. So long as perverted theocratic systems of power attempt to manipulate our communities and distort truths for political gain, we will rebel."

Satan worshipers believe that "Satan is representative of the eternal rebel, enlightened inquiry and personal freedom," proclaims the Satanic Temple's web site.

Planned Parenthood losing social-media war sparked by undercover videos


Planned Parenthood for America is losing the social-media war in the aftermath of undercover videos on its fetal-tissue donations from abortions, according to an analysis released Friday.

NetBase, a Silicon Valley firm that analyzes social-media trends, found that “net sentiment” toward Planned Parenthood turned “decisively negative” after the July 14 release of the first video by the pro-life Center for Medical Progress.

The center has released a total of seven videos as part of its Human Capital project, with the latest one posted on Wednesday.

“PP’s Average net sentiment for the three months leading up the release of the first video was +62; as of August 20, 2015, PP’s sentiments stands at -26,” according to the NetBase analysis.

Even though network television coverage of the videos has been sparse—just 23.5 minutes on ABC, CBS and NBC in the few weeks, according to the conservative Media Research Center—the NetBase figures reveal a different story on social media.

The analysis found that conversations about Planned Parenthood have “exploded on social media,” from about 4,500 daily mentions in the three months prior to the release of the first video to 121,661 mentions in the first 24 hours afterward, an increase of 2,600 percent.

As for the hashtag war, #DefundPP and #PPSellsBabyParts combined for 965,479, while #StandwithPP and #SupportPP had 271,925.

The mentions were fairly evenly divided between men and women, with 55 percent from men and 45 percent from women.

“In the three months preceding the release of the first video, the ratio of positive to negative comments about PP averaged 4:1,” said the analysis. “In the week following the release of the first video negative comments surpassed positive ones with a ratio of 3:2.”

Total mentions on social media peaked with the release of the fifth video Aug. 4 with 350,121. Since the release of the seventh video, there have been 97,815 mentions.

The center has accused Planned Parenthood of profiting from fetal-tissue donations from abortions performed at its clinics, which the organization’s leaders have staunchly denied.

Court Removes Injunction on Planned Parenthood Video, New Video Immediately Released






Los Angeles Superior Court Judge Joanne O'Donnell ruled on Friday afternoon the Center for Medical Progress has First Amendment rights to release videos it covertly took of StemExpress executives talking about buying aborted baby tissue from Planed Parenthood. Almost immediately afterwards, CMP released a new video that among other thing showed the StemExpress CEO Joking about receiving entire dead babies from Planned Parenthood (over lunch).

This latest video is only two minutes long and is more of a trailer of things to come. Most of its content was made up of bits and pieces of previous videos. The one new section featured Cate Dyer, the CEO of StemExpress in a lunch meeting with undercover operatives posing as representatives of a biotech firm. Dyer is seen laughing about how StemExpress purchases fully intact aborted babies from Planned Parenthood. As she paid the check, Dyer is laughing about how shippers of the aborted babies should give a warning to lab workers to expect such a whole (intact) baby.

“Oh yeah, if you have intact cases — which we’ve done a lot — we sometimes ship those back to our lab in its entirety,” she says.

“Tell the lab its coming,” she laughs about the intact unborn babies. “They don’t want to open the box and go ‘Oh my God!'” Dyer adds.

Once the CMP videos began to be released, StemExpress realized a lunch they had back in May was probably an undercover sting, so they sued to preemptively block those videos from being seen.  Judge O'Donnell issued a restraining order barring CMP from releasing any videos showing current or former Stem Express employees, at the end of July - then rescinded the order today.

The Center for Medical Progress isn't off the hook yet because the Judge say that even though they couldn't' be prevented from releasing the video, it was likely that StemExpress prevail in its lawsuit claiming its privacy was violated.

Earlier this week StemExpess announced it was cutting all ties with Planned Parenthood, but denied that it had done anything wrong.

The newly-released video is below, but expect more to come next week.

New CMP video: “And she just taps the heart, and it starts beating”



The Center for Medical Progress has just released a new video this morning, which continues its in-depth interview with former StemExpress procurement technician Holly O’Donnell. In this video, O’Donnell describes how she saw her supervisor tap the chest of “the most gestated fetus” O’Donnell had yet seen in her work — and the heart started beating. Nonetheless, the child was killed and dissected. In another case, O’Donnell describes being instructed to extract a brain through the face of a cadaver. “I can’t even describe what that feels like,” O’Donnell says.

The series focuses on the personal narrative of Holly O’Donnell, a former Blood and Tissue Procurement Technician for StemExpress, a biotech start-up that until last week was partnered with two large northern California Planned Parenthood affiliates to purchase their aborted fetus parts and resell them for scientific experimentation.

O’Donnell describes the harvesting, or “procurement,” of organs from a nearly intact late-term fetus aborted at Planned Parenthood Mar Monte’s Alameda clinic in San Jose, CA. “‘I want to see something kind of cool,’” O’Donnell says her supervisor asked her. “And she just taps the heart, and it starts beating. And I’m sitting here and I’m looking at this fetus, and its heart is beating, and I don’t know what to think.”

The San Jose Planned Parenthood does abortions up to 20 weeks of pregnancy. Referring to the beating heart of the aborted fetus, O’Donnell remarks, “I don’t know if that constitutes it’s technically dead, or it’s alive.”

State and federal law require that the same treatment be given to an infant born-alive after an abortion as to a normally delivered baby (1 U.S.C. 8, CA Health and Safety Code 123435). California law also prohibits any kind of experimentation on a fetus with a discernible heartbeat (CA Health and Safety Code 123440). StemExpress has been cited in published scientific literature as a source of fetal hearts used for Langendorff perfusion, which keeps a heart beating after it is excised from the body[.]

O’Donnell also tells how her StemExpress supervisor instructed her to cut through the face of the fetus in order to get the brain. “I can’t even describe what that feels like,” she says.



This is not just O’Donnell’s imagination. CMP’s investigators also get the executive director of Novogenix Laboratories, Dr. Ben van Handel, to acknowledge that “there are times when after the procedure [abortion] is done that the heart is still beating.” Planned Parenthood’s Dr. Deborah Nucatola says during the wine-and-salad lunch that abortionists use digoxin to kill fetuses in order to avoid violating the Born Alive Infant Protection Act, but digoxin renders the tissue useless for researchers. To get the value of the tissue, the fetuses cannot be poisoned — and as a result, live babies result in many cases.

Toward the end, O’Donnell relates another heartbreaking story of a dissected child, and the need to dispose of him. The body was too large to fit into the container, got stuck, and O’Donnell had to work it into the medical-waste disposal bag. “It was really hard knowing that you’re the only person who’s ever going to hold that baby.”

Abortion kills babies, but sometimes abortion isn’t enough to finish the job. These clinics are killing children born alive from these procedures, simply to harvest their organs. That violates the federal BAIPA law. Will the Department of Justice enforce it?

Arkansas and Utah defund Planned Parenthood over aborted baby parts scandal


WASHINGTON, D.C., August 17, 2015 (LifeSiteNews) — Two more states have defunded Planned Parenthood in light of videos showing the organization is engaged in the illegal sale of body parts from aborted babies.

On Friday, Utah Gov. Gary Herbert said that “allegations against Planned Parenthood are deeply troubling,” and ordered his state’s Department of Health to stop sending federal funds to Planned Parenthood.

Arkansas Gov. Asa Hutchinson likewise said his state was ending Medicaid contracts with Planned Parenthood. “It is apparent that after the recent revelations on the actions of Planned Parenthood, that this organization does not represent the values of the people of our state and Arkansas is better served by terminating any and all existing contracts with them,” Hutchinson said in a statement.

More than $400 million of Planned Parenthood’s over $500 million in public funding comes from Medicaid and other programs that combine state and federal funds.

July 29, 2015 - ( Fox News - The Five ) - Greg Gutfeld was excellent on The Five today as he destroyed the arguments that liberals like Julie Roginsky make in favor of harvesting aborted baby parts. His main point was that they argue on one hand that it’s not a baby, that it’s just a clump of cells and it’s garbage. But when it comes to harvesting these baby parts for medical research, all of sudden it’s not garbage, but rather something valuable and necessary. Julie Roginsky tries to counter him, but ends up making his point at the end. And while she wouldn’t cede defeat to Gutfeld, Kimberly Guilfoyle chimes in, rendering judgment. But you’ll have to watch to see what she says.

Center for Medical Progress May Win Abortion-Related Prior Restraint Fight In Los Angeles


StemExpress’ initial success now appears unlikely to continue. CMP has filed a well-drafted anti-SLAPP motion attacking the StemExpress complaint. I’ve explained how anti-SLAPP motions work before. If you’re being sued for speech, and you believe the speech is protected, you can file the motion, lay the factual framework for the speech being protected, and force the plaintiff to come forward with admissible evidence showing it could plausibly succeed on its claims. Moreover, an anti-SLAPP motion halts discovery absent a special order of the court.

StemExpress had demanded early expedited discovery into the case; that request was thwarted by CMP’s anti-SLAPP motion. So they appealed to the court under part of the anti-SLAPP statute for special discovery — an exception to the general rule that discovery is stayed when the motion is filed. They wanted, for instance, to gather evidence that would help them transform their brief temporary restraining order into a longer-lived preliminary injunction, which requires more proof.

The L.A. County Superior Court’s decision does not bode well for their project. In what appears to be a tentative ruling, the court refuses their special discovery request, saying they have not shown adequate cause. More specifically, the court suggests there’s no need for discovery in support of a preliminary injunction the court is not inclined to award:

Plaintiff does not persuade the Court that the discovery it seeks is necessary to obtain the preliminary injunction. That is because it appears unlikely that the Court is going to grant the preliminary injunction. The injunction Plaintiff seeks would prevent Defendants from disseminating the videotapes. First, this proposed injunction would constitute a prior restraint on the Defendants’ rights under the First Amendment and the parallel protections under the California Constitution. US Const. Amend. I; Cal. Const. Art. 1, § 2. Therefore, it is unlikely that the preliminary injunction will ultimately be granted.

Yes, it appears that the court has been awakened to the prior restraint implications of prohibiting distribution of a video.
