Small claims or any other court will only get you a judgement.  You still have to collect afterwards.  Something that's physically impossible with bitcoin.

With bitcoins i would agree it would be intresting to see any judge deal with bitcoin.  Those with wiretransfer will have much easier time.

Awesome accomplishment Smiley  Congrats to all concerned!

Has anyone gotten the I2C to work, so maybe the K64 will work too?

From the klondike k16 thread , 350Mhz

Thanks to Steamboat & Kano & others who helped save the Klondike  Grin

http://i63.photobucket.com/albums/h148/Bigblock462/Profit%20calc/BFL%2030GH/DSC02495_zps3bf06e23.jpg

Works like a champ!!!!!!!!!!!  Cool

For each K16, the components including the heat sink, board, power cables, etc. cost us around $45. And we were prepared to assemble around 5,000 K16s (for 80,000 chips). There goes $250,000.

Why ?
The Fear/doubt spread by a few members (along with the delay from Yifu) lead to a lot of refund requests. The result of which was that, if we continued with the project, we would have been left with inventory worth hundreds of thousands of dollars in our hands. And it would have been almost impossible to sell it at a price where we could even break even. Even if nobody asked for a refund, we would still have been left with about $125,000 worth of useless components (read point 4 above). But with about half of our customers asking for a refund, we would be stuck with another $350,000 worth of inventory that we couldn't have sold for more than $150,000, putting us under red for over $300,000.

-->> Point 4. The Power Inductor 38L361C was not available anywhere, so we instead bought SPM10040T-R36M170. But the latter was not pin compatible with the former. So we ended up changing the circuit board. I will publish the updated KiCad files.

If pushed into a corner, I will defend myself.

Theres 2 Power Inducator http://www.oemstrade.com/search/SPM10040T-R36M170/ that go on a k16 board, and there 1.16$ each.

thats 10,260$ on these for 5k k16's,then they claim to have changed the circuit board, no word on the updated kicad files for a month.

One picture Th posted of k16 x4 shows these power indicators.

And don't tell me you went on to reprint 5k circuit boards because of a power indicator.

Everyone else assembling the k16s seemed to have found the original Power indicator....

Where is this 125k of "useless components" coming from?

Avalon even had the 10k chips for 100BTC for over 2 weeks on their website. Could have bought those and put together the boards.

They even posted a code on Bkk thread with the dam firmware for the k16 to work 100%.

All this shit and then you add the 50% refund crap, then you go off posting shit like the corner dog bullshit.

Could we poss have the names and faces behind the venture please? And any relevant backgrounds. It's kinda nice to know who's who, increase confidence, etc...

Sure, we'll create a "Our Team" page on the website. By the way, my name is Amir.

Heres another person with the k16 assembled, on AUG 15TH.

So what I think I understand after reading this thread is that if you paid with BTC, then there is not much legally that can be done?  Just wait for Amir to give us 50% in 3 months from several weeks back?

No. If you didn't pay with Paypal or Credit Card it will be harder to get your money. Doesn't matter what you paid with.

The law says in the States that you can get a refund at any time if you have not received the merchandise you payed for.

Well I can admit, when time is in the game, everything from providers seems to take a years Wink

Each bit of time Amir is getting salary, so it will likely just go on.

So I take it we've been completely out of any kind of contact with TH since their last statement.
Nice of them to continue on the same path of exemplary customer service.

If TH would refund us the BTC for just the chips that they got from Avalon we all would be paid in full due to the current BTC price.  I really hope they do that, they can keep whatever from the parts and from people that don't respond but give back what you got from avalon which for each K64 would be 5BTC, 5BTC now is over $1,000 so we would not be out any money.

They could then declare bankrupt and say screw you to the creditors.

This is exactly the way bASIC made it out alive (and in my estimation made a really NICE profit from it as well).

If you don't remember the bASIC story it was very interesting!  He, in a nut shell took all kinds of BTC in pre-orders (at about the same time BFL started taking pre-orders) claiming he was going to make an ASIC miner (as he already had a little FPGA company).  After a few months it was clear he didn't have anything done (let alone the skill set required to have chip manufactured) all this right around the time of the first really big run up in BTC price.  He then proceeded to refund everyone their money, in BTC at CURRENT BTC value, claiming as many manufactures have that the units were priced in USD so you would get an equivalent USD refund in BTC at the current exchange rate.  I never saw a reasonable estimate but it appeared as though he took in thousands of BTC at a very low value (low single digits IIRC) and then sent back much less BTC for refunds but the coins were worth a lot more (3 digits).  I never saw an explanation for where those coins went either, I have always assumed he kept them, and if he sold them at or near the top of the last bubble he could have made A LOT of fiat.  Hell if I was asked to make a guess I would estimate he made several hundred thousand if he did actually keep all those extra BTC.

Edit: If TH can pull off a bASIC they will have just hit their miracle one outter on the river with this big run up.

Exactly. They are gambling with our refunds now. This is hilarious.
If BTC goes down they might say: Sorry we have only 50%. Sorry, but this is how it is, blame PayPal refunds!
If BTC goes up they might say: We have salvaged 5% from parts and 50% refunded from Avalon. So 55% is fair.

Stash from preorder money already covers 110% of sum required to fully refund all 40.000 ordered chips. So what is the delay?!

Heh, yeah interesting strategy hammurabi! However I hope they speak soon. BTCs are just standing there and if he has not some major problem, I don't think what else would he be doing ...
