My personal opinion on the matter: To let go free the rapist if the victim ONLY has the right to agree to marry him or death punishment if she doesn't agree.
This seems like a good system. In any case if they marry then she can divorce the next day and take half. Some of those marry the rapist rules are from old times when a woman couldn't divorce and take half, but there may have been rules in place where she and her children would inheret land and other property that the rapist had, so she was better off this way. If she was mistreated then she could leave but the inheritance would still apply.This brings up another question I have. In America today how is rape treated as a civil offense? Can the rape victim collect damages from the rapist? What if the rapist is in jail from the criminal offense and doesn't have a job or money anymore?
The other thing that seems to be the case is that at least in the USA all cases of rape are sort of treated the same legally regardless of the circumstances. If a couple has consensual sex and then the next day the guy rapes here it's not really the same as if he was a stranger. Do people here think that how severe rape is depends on the circumstances?
