Alternatively, they knew from the beginning that they will rip off their clients and put the "business"-paragraph into their TOS, planing to refer to it once the whole operation blows up.

Perhaps a little harsh, but yes, this was deliberately added to remove any fallback on consumer protection laws.
Bitcoinorama shilled really hard to make it sound like it didn't matter, but hey, he was wrong.
Haven't seen him around much since he got paid, have we?

Last time I saw him was at the BTC Conference in Austin back in.. March?

i read alot about those frankenjups being built from used parts. is there any proof for that? i mean was there dust in the coolers or something like that?

Here you can see through the bubble wrap packaging that the coolers have old thermal paste, showing they are old and used

thats hardcore

That's hardcore, indeed. And it seems as if it was planned. KnC writes in its TOS:

Quote
1.2 The Products are sold for business use only and Purchaser hereby accepts that it has purchased the Products in order to conduct a business.

Now KnC's "Kurt" translates this into:
Quote
What you agreed to states that you are purchasing as a business in a business to business transaction, you are not a consumer.

English isn't my first language, and maybe I totally misunderstand this. But  first of all: If KnC would like to make a deal with a company - which would clearly be a business - then they would give the option on their homepage to register as a company. This is not possible. You only can register as a private person.

So they knew from the beginning that they will mainly deal with individuals.

Now they write in the TOS: "for business use". And "in order to conduct a business."

WIth no word they write that the buyer IS a business. Nevertheless, "Kurt" now says that all transactions were of a "business to business" nature.

Why does he write "you are not a consumer"? Because KnC is afraid as hell that the Swedish Consumer Protection Agency (or however you call this thing) may jump on their back. Therefore he is whining that "you are not a consumer". What they delivered with the Frankenjups is potentially hazardous - and could mean a lot of trouble with Consumer Protection. Not only in Sweden, but all over Europe. And I guess in the US, too.

Alternatively, they knew from the beginning that they will rip off their clients and put the "business"-paragraph into their TOS, planing to refer to it once the whole operation blows up.

[Tinhead on] Meanwhile, I wouldn't exclude this... [Tinhead off]

https://bitcointalksearch.org/topic/closedspondoolies-tech-sp10-14-145ths-2795-shipping-598502

in stock units

that is 4.5th (+10%/-10%)

there may be a reason the refunds have stalled huh?

I don't care about any other machines (they are all unprofitable anyway at BTC $440), I just want my money back (BTC, wire, whatever).

On the phone, they tell me that they can't look where in the payment queue I am. However, in the KnC-forum, "Kurt" writes:

"BTC refunds will not be sent instantly, there are procedures that we must follow before we issue refunds, there are also many other customers before you in the queue. The delay will be a matter of days, compared to weeks like the delays with bank transfer."

So how does he know where in the queue I am when he can't check the queue?

Also funny: In the past, KnC mined with Eligius with the address 1A73ExsM2doRwTLp82rv5U36QHbBFmHD1X. Today, it seems they are mining 140'000 US$ a day.

Bitcoins for about 9 million US$ were transferred during the last days to another wallet which seems to be from KnC, too. From this wallet, lots of payments were made, some of them in amounts which look "familiar", i.e. it seems that they are paying their "customers" - at least with parts of these Bitcoins.

If this is so, then their problem could be that they are not producing Bitcoins as fast as they have to get them back to former clients, i.e. they not only seem to have a cash-problem, but also a Bitcoin-problem.

But as you see: I'm a newbie, and maybe, I am totally wrong.

So there are just my 2 Satoshi...

All these people/companies have multiple wallets and addresses , and switch pools like crazy.  Is it wonder the "dark pool" is so large.

Got my refund too. Today makes it just under a month since the refund request was made for my 2nd (and last unit).

Imho, KNC feels like a house of cards at the moment that will stay up as long as they can get fresh funds $$$ in or mine enough BTC for the refunds. So I took the BTC refund instead of the wire transfer that never went through.

For what it's worth though, thank you the refund (and customer service for the prompt replies) and good luck to those still holding out

Cheers

House of cards?

I want to be that house of cards!!

They mine more BTC in a few weeks than they make selling Neptunes, Frankenjups and controller cards.

Customers to them are like a mosquito buzzing around them during a dinner party.

well the fankenjupiters were genius on their part ...assuming they would have shipped them correctly and they would have actually worked that is...now not so much...but if they HAD gotten them out with out wreaking them and with clear instructions and not junk cases etc....no one would have complained much they were used...

by doing so...giving a no refund option on 400 Neptunes to that antsy types likely to 'refund' and giving them used equip....and imho then taking their neptune orders and eventually rotating them back to the knc farm or for re sale it would have killed

400 neptunes x 10,200.00 assuming CA prices...means they would save $4080000.00 usd (their 400 frankenjupiter numbers)

now that it wall went to sh*t with shipping issues lousey setup etc..they are sticking with it...so RMA tag shall ensue ...I mean
they can RMA broken boards back and forth used etc till 'eventually' you MAY get a complete 3TH unit ..but no refund sorry

imho the idea was killer from an 'evil genius' point of view...but the implementation fell through....much like BFL the schemes are genius..the actual execution can't fly

meanwhile back at the giant PH farm they have added another top row of shelves and miners....

sigh

31 days after my Refund request Anna keep rolling the same " it will be transferred in few weeks" .

One month lies and BS.

Is it sure that the bank accounts of KNC are still not blocked by Swedish government?

Something start smell here. 1 Month for refund is really a lot, even for cheap bastards like KNC.

Just to remind you guys:

Don't send any Money to KNC. Don't buy any nonrefundable hardware from them.

KNC is SCAM NOW and they going to score Fraud of 2014. Hold on for Q5

You should ask refund in BTC, forget about bank wire and call them daily.
