Let's say I generate a new address and by some miracle it has Bitcoin already in it belonging to somebody else. Is it legal to just take it? I understand those odds are very low, no need to lecture me, I'm just interested.
Stealing is always stealing, no matter what if this is cryptocurrency or teaddy bear or candy. Its forbidden by law and pursued by authorities.
So just dont.
Its something very unusual to get, generating a new adress and it has some coins inside, makes no sense, but someone had reported this kind of situation already, but well how to deal with such situation, as the owner doesnt know someone else has acess to the coins, atleast i do believe in that. I would be pissed if someone make a new adress and take my bitcoins away.

Wow. This truly happened? I thoughy addresses are unique and its like a .00001 percent before it can generate the same address. It is almost like impossible. It is really a miracle but who would rely on that and many addresses have nothing in their accounts.

i agree with you , you are right that every thing stealing is illegal , so its not good that steal something from other i think they can get punished by law.

Stealing can be be illegal because if you are arrested by NBI it means its illegal also bitcoin is money so its illegal to steal bitcoin to others..
of course it is definitely illegal and you cannot steal from the people because you would surely get a lot of trouble with law

Stealing could be illegal but it doesn't mean that bitcoin would be illegal, bitcoin is mean money, we use bitcoin and we earn bitcoin in a different ways. In my view, only illegal ways of earning is illegal not bitcoin.   
it not only could be illegal but it is really illegal and i think that it will never be an allowed thing to do to be honest

Stealing is taking another person's property without permission or and without intending to return it.  Since you said that what if you bought address with a bitcoin already on it, well conscience of yours would be the judge.  In the first place the owner did not know and it is clear to his mind that you are not doing anything wrong.  So it is likely you did not stole it but seems like that since you know that it really belongs on him.  But stealing is of course illegal.
Well yeah stealing is always illegal, in every ways and every countries and that’s the fact which everyone knows but in your case, which you have a bitcoin wallet with bitcoin in it, I don’t know should we ever call it stealing. I mean this is like one in a billion and it’s an incredible and unbelievable coincidence so it’s up to you now, only conscience can answer.

I will guess to think that anything that has value to someone and that does not belong to you, in obtaining it without their consent is stealing.
There are laws in place to protect people from having their possessions taken from them without any authorization from them.

It is illegal because you are stealing something and this is money, maybe bitcoin does not have any value to most people in the world but it is very valuable in the crypto world and doesn't cost cheap, whatever the amount is it is still stealing money.

I couldn't agree more with you, no one can say that bitcoin is illegal. But when you stealing bitcoin from other , it can say that your bitcoin balance is illegal. Illegal ways to earn bitcoin can makes your bitcoin legal or illegal.
in my opinion we can say bitcoin is illegal because we are still fight with government for them accept existence of bitcoin may be it will take a bit long time since still many illegal activity with bitcoin.

Stealing anything is not legal. Be it bitcoin or fiat money. What made you think that stealing bitcoin may be legal?

But stealing less numbers of bitcoin will have less impact and you may not get any help from police about it because bitcoin is online and police will have difficulty to understand what is bitcoin. SO if your fund is stole, go find it on your own.

And besides no one to blame but the bitcoin user itself if ever their bitcoin will be stolen or not.

Almost most of the users here stated that they want bitcoin because they have the authorization of their money but when stolen or got lost, ended up crying for help to others.

Any stealing act for anything to anyone is still illegal wether it is online pr not.All stealing avt is considered a crime as long as you dont have permissions of the real owner

The real owner? Who decides that if it's possible for me to generate the same address? Just because I generated it after shouldn't mean it's illegal. It's not like exploiting an online wallet to steal private keys and drain the accounts.

I feel like you guys are just guessing to be honest, I want to know if it's legal or illegal to take bitcoins out of an address you just generated. Tongue

Okay I will say my oppinion,correcting me if I am wrong okay. If you generate a NEW bitcoin adreess and it has been some bitcoin in it that you aren't planed before. May be some one was doing a mistake to sent bitcoin to you're address. But you aren't planned it before,are you?, if you know who was sent it so send back to the owner if you don't know whos the owner just take it for you're self. May be you just lucky or just pretend that god was sent you a give. Correcting me if I am fals please.

Generally even though BTC is not yet accepted by all country Stealing is a crime. It involves a part of your asset being transferred illegally to someone else's pocket or wallet.

ahah, perhaps he would like to convince yourself not to do anything wrong. Or he thinks that bitcoin is one of the thieves, etc. So indeed the theft is a crime and all the people would know, though things are stolen is something worthless or unknown person.

Maybe hes dumb enough that he doesnt  know whats the definition of stealing to him. As he said  he generate an address which theres already  a bitcoin inside it, if  he try to get those coins then its considered stealing. No questions asked.

You have a point, there's no need to ask this kind of question since yourself could even do that. Stealing is illegal in any way, anything that you stole or get without the owners permission or notice then it's considered illegal. No matter how big or small amount is if you get those then you commit such crime.

may be he did really steal some bitcoin before and now he is guilty of spending it. that is why he is asking these question on this thread to see if someone did the same thing he did.

Pretty sure that didn't happen. The chances are very low that that will happen. I think this is more of a philosophical discussion.
