what should i say, yesterday my Order (Orderdate 12 January) arrived Smiley sceduled delivery was 2nd week of march.

I called them yesterday, and they told me that the had some cash-flow problems, but they where refunding 2-3 ppl a day..

The told that they had made a list of ppl that are waiting for the refund, and they are following the list... (according to bitmine)


So I am still dreaming of getting my cash back.   Cool

they have talked about that list now for a couple of months but still I guess nobody has gotten a clue about the order of refunds on that list
order 4xxx refunded before 2xxx even if 2xxx has asked for refund ~2months earlier than 4xxx and so on...

I have requested for refund 10.5

I was calling them on last Friday and they said that I'm in the middle of the refund list, it will take +- 14 days to receive my refund.
I hope so. My refund is today 12 days over the time.

Kerim has sent me a mail once where he stated that he had sent a list 27.5 of orders which should have been refunded latest 30.5
My name was on that list but still hasn't received my refund.
I have tried to call them today but they did not answer.

I'm also a bit concerned when I have looked at their BTC-wallet and noticed that there has been some suspicious activity there.

I'll try to call them tomorrow during the open hours in the middle of the day and try to get an answer from them that what the status is for my refund.

These last days, CYCO has received a significant number of claims regarding the website bitmine.ch owned by the company Bitmine AG. Indeed, it seems that the company has troubles to deliver their customers and promise reimbursements. After some research, it appears that many other clients complained about the same problem in discussion forums over Internet.
 
In principle, under Swiss law, a delay in delivery does not necessarily constitute a criminal behavior of the seller. A purchase on the Internet creates primarily a contractual relationship (object against the sale price). If delivery is not made, the Swiss contract law gives buyers different ways to act. They can especially give the seller more time with the threat that if he still does not execute the delivery, they can terminate the contract and ask the money back. There is fraud (art. 146 of the Swiss criminal code), and thus a criminal behavior, when the seller does not intend to deliver/refund its customers. In certain circumstances, courts require a prior verification of the real intention.
 
Therefore:
 
- in any case, you can act through the civil process against Bitmine AG, but most of the time it will need a lawyer due to the difficulties of the civil procedure;
 
- if the conditions of fraud are fulfilled according to Swiss law (art. 146 CP), you have the possibility to file a complaint to the public prosecutor of canton of Ticino (Ministero Pubblico, via Pretorio 16, 6900 Lugano). If you live abroad, you may have also the possibility to contact the competent authorities of your country to file a complaint.
 
Moreover, as prevention, before making a purchase on the Internet, always check whether other customers have rated the online store concerned. Rogue sites are pilloried by users, often in discussion forums, allowing to warn other potential customers. Such verification can be done by a simple query in a search engine.

I don't think so.  Once a company is flagged up as "dodgy" with national authorities and local police, then it's "no smoke without fire...."

Sehr geehrte Damen und Herren,
 
In den letzten Tagen hat KOBIK eine beträchtliche Anzahl von Beschwerden/Meldungen in Bezug auf die Website bitmine.ch, die im Besitz der Firma Bitmine AG ist, erhalten. Tatsächlich scheint es, als hätte das Unternehmen Probleme zu Liefern und Versprechen auf Rückerstattungen der Zahlungen. Einige Recherchen im Internet haben gezeigt, dass es noch sehr viele weitere Kunden gibt, die in Diskussionsforen im Internet über dasselbe Problem berichten.
 
Grundsätzlich stellt ein Lieferverzug nach Schweizerischem Recht nicht unbedingt ein kriminelles Verhalten des Verkäufers dar, weil ein Kauf über das Internet in erster Linie ein privates Vertragsverhältnis (Verkaufsgegenstand gegen den Verkaufspreis) bewirkt, weshalb Privat- und nicht Strafrecht zur Anwendung gelangt. Falls die Lieferung nach dem Kauf nicht erfolgt, bietet das Schweizerische Vertragsrecht dem Käufer verschiedene Möglichkeiten gegen den Lieferverzug vorzugehen. Der Käufer kann dem Verkäufer mehr Zeit zur Lieferung einräumen oder vom Vertrag zurücktreten. Strafrechtlich relevant wird das Verhalten des Verkäufers erst dann, wenn er von Anfang an nicht die Absicht hatte, die Ware zu liefern. In diesen Fällen kann dann Betrug nach Art. 146 StGB vorliegen, wobei aber dem Täter die innere Absicht zum Betrug nachgewiesen werden muss.
 
Daher gilt grundsätzlich Folgendes :
 
Sie können zum Einen zivilrechtlich gegen die Bitmine AG vorgehen, indem Sie Ihre Rechte gemäss Schweizerischem Vertragsrecht (Obligationenrecht) wahrnehmen und dem Verkäufer eine letzte kurze Frist zur Lieferung der Ware unter Androhung des sonstigen Rücktrittes vom Vertrag ansetzten. Liefert der Verkäufer innert dieser Frist nicht, können Sie vom Vertrag zurücktreten und das Bereits bezahlte Geld zurückverlangen. Am besten reichen Sie dazu eine Betreibung ein. Da dieses Vorgehen nicht ganz einfach ist, empfehlen wir Ihnen, sich mit einem Anwalt, der auf Zivilrecht spezialisiert ist, in Verbindung zu setzen.
 
Sofern es sich jedoch um einen Fall von Betrug nach Art. 146 StGB handelt, haben Sie die Möglichkeit, bei der Kantonspolizei an Ihrem Wohnort oder direkt bei der Staatsanwaltschaft des Kantons Tessin (Ministero Pubblico, via Pretorio 16, 6900 Lugano) Anzeige zu erstatten. Sofern Sie im Ausland leben, haben Sie auch die Möglichkeit bei der dortigen Polizei eine Anzeige zu erstatten.
 
Zudem, als Form von Prävention, dürfte es in Zukunft bei Käufen über das Internet wichtig sein, dass Sie das Angebot und den Verkäufer immer genau prüfen und auch schauen, wie die Bewertungen dieses Unternehmens durch die andere Kunden lauten. Es gibt verschiedene Webseiten, wie z.B. scamadvisor.com, unter denen man nachschauen kann, wie gut das Trust-Rating diverser Webseiten eingestuft wird. Es sind aber auch einfache Suchabfragen auf Google oder einer anderen Suchmaschine möglich, um zu schauen, wie der bisherige Ruf des Unternehmens ist.
