One day after former President Donald Trump's classified documents trial was postponed indefinitely after we learned that the DOJ mishandled evidence in the case (with Judge Aileen M. Cannon citing a mountain of 'outstanding' pre-trial matters that would make a May 20 trial 'imprudent'), another Trump case appears to have no chance of going to trial before the 2024 election.

On Wednesday, a Georgia appeals court agreed to review a lower court ruling which allowed Fulton County District Attorney Fani Willis to remain on the Trump RICO prosecution despite being highly conflicted.

To review, Atlanta Judge Scott McAfee of Fulton Superior Court, who donated to Fani Willis when she was running for office, ruled in March that the Fani simply had to kick her lover, Nathan Wade, off the case after she paid him more than $600,000. The two notoriously took several lavish vacations together on Wade's dime (which Fani swears she repaid in cash).

According to McAfee, while he found the "appearance of impropriety," no "disqualification of a constitutional officer necessary when a less drastic and sufficiently remedial option is available," adding "that the prosecution of this case cannot proceed until the State selects one of two options."

And now, the Atlanta Court of Appeals has agreed to hear an appeal from the defendants over whether McAfee erred in his decision.

Willis indicted Trump and 18 other defendants last August, accusing them of a wide-ranging scheme to attempt to overturn the results of the 2020 presidential election in the state. All of the defendants were charged under Georgia's Racketeer Influenced and Corrupt Organizations, or RICO, law. Trump and most of the other defendants have pleaded not guilty.

About the gag order. I have seen lately in many summaries and commentators channels about the fact the judge continues to fine for thousands of dollars to Trump and his team because he does not seem to care to continuously violate the gag order out upon him.
To me, it would seem obvious Trump would be glad to become the first ex-president to ever spend a night in jail for not keeping his mouth shut outside trial.
He is aware his popularity among Republicans seemed to increase with each indictment he accumulated as legal problems started to accumulate, so he could assume that being jailed and keep playing the victim with that could give him a boost in the polls leading to November. That is the only logical reason I can think of about why he is not willing to shut up and focus on talking on politics instead.

Still, very far away as a possibly for him to spend a day in jail, the judge knows he does jail Trump, it could affect his career and go down in the history books...

Stormy testified to irrelevant yet very salacious details about her sexual encounter with Trump that allegedly happened many years ago.

She was also reportedly making scripted jokes in the courtroom to win over the jury but nobody was laughing.

Trump walked out of the court and spoke to the media. He used a clever trick to avoid violating Judge Merchan's illegal gag order.

The fact that Trump had sex with Stormy - who persistently calls Trump "tiny" - does not really need to be proven, Trump is not accusing of fucking blondes, he is accused of falsifying accounts and the problem with that is that these leave records.

Seems that the so-called hush money was simply pay for legal expenses. The fact that Trump didn't say anything about what the money was for, doesn't mean that it was to be used as hush money. People make standard payments to attorneys all the time with the understanding that it is for legal fees.

More and more things are turning out that show that Trump is innocent of wrongdoing. None of this Deep State stuff is going to keep Trump out of office. The appeals, alone, if he is found guilty of anything, will take so much time that Trump will be our next President.

Former Trump Organization controller Jeffrey McConney testified Monday that payments that were sent to former attorney Michael Cohen were legal expenses, confirming defense attorneys' arguments.

"Michael Cohen was a lawyer?" Trump defense attorney Emil Bove asked Mr. McConney. "Sure, yes," he replied.

"And payments to lawyers by the Trump Organization are legal expenses, right?" asked Mr. Bove. "Yes," said Mr. McConney.

Later, Mr. McConney said that President Trump and Trump Organization official Allen Weisselberg never told him to log the payments to Mr. Cohen as legal expenses.

"President Trump did not ask you to do any of the things you just described?" the attorney then asked. "He did not," Mr. McConney replied.

"And as far as you know, President Trump did not ask anyone to do those things?" Mr. Bove continued. "In none of the conversations that you had with Weisselberg, did he suggest that President Trump had told him to do these things?" he also asked.

"Allen never told me that," Mr. McConney said.

Mr. McConney said his interactions with Mr. Cohen were "minimal." He said that other than emails about invoices, he never spoke to Mr. Cohen about the reimbursement arrangement.

In court papers, Trump lawyers have described that the payments that were sent to Mr. Cohen as legal expenses, while prosecutors say that it was an attempt to cover up the true nature of the payments during an election. Mr. Cohen used the funds to pay adult film actress Stormy Daniels to not speak publicly about allegations about an affair in 2006, which President Trump has denied.

What's worse, allowing Trump to attack the jury and witnesses, or allowing the circus that will ensue with locking up a former president for a few nights distract from the actual proceeding. 

Consider this, it won't be possible to prevent the jury from learning that Trump was thrown in jail.  But the contempt charges shouldn't be considered in deciding his guilt - which is why all the gag order related motions happen when the jury isn't in the room.  Jury bias from the contempt jailing could very well end up being Trumps strongest and only non-frivolous argument to make in appeals if he's convicted.

Special Counsel Jack Smith's team admitted on Friday that key evidence in Trump's classified documents case was altered or manipulated - leaving two different chronologies; one that was digitally scanned vs. what's in the actual boxes.

Smith also misled the court, after originally telling U.S. District Judge Aileen Cannon that the boxes remained "in their original, intact form as seized," when in a footnote they conceded that they removed classified documents and left placeholder sheets, which prosecutors acknowledged has created an "inconsistent" record - in which some of the documents are no longer in the same order as they appear in digital scans made in the fall of 2022.

"The Government acknowledges that this is inconsistent with what Government counsel previously understood and represented to the Court," the footnote reads, according to Just the News.

The finding comes after Cannon ordered a review into whether the FBI may have seized legally privileged records in response to a request from Trump co-defendant Walt Nauta.

"Since the boxes were seized and stored, appropriate personnel have had access to the boxes for several reasons, including to comply with orders issued by this Court in the civil proceedings noted above, for investigative purposes, and to facilitate the defendants' review of the boxes," wrote Smith's team in the Friday filing.

"There are some boxes where the order of items within that box is not the same as in the associated scans," the filing continues.

The organization of the documents in storage boxes at Mar-a-Lago is likely to be an important part of Trump's defense. His team is expected to argue the documents were stored in the White House in chronological order on the days that Trump received them, and that staff simply boxed them up and sent them to his home without him accessing them or knowing they contained classified information.

If you think of it, is quite the opposite, a President knowing that is immune from anything could, for example, order the killing of any opposition. Gates open for a Tyrant.

But alas, this is the type of judges that the Republicans put in the Supreme Court. But of course, there is a strategy behind this orchestrated delay of "sending back to lower courts".

My guess is that most of the judges would very much like to say that Trump is not immune from crimes done for his own benefit, but many of them are good dogs and some scared dogs. They would rather delay the issue until it is dismissed.

Trump just cannot help it. He just violated a gag order. Previously, he has been fined for tweeting shit about judges, their families, the witnesses ... beyond anything that you may have seen before in the US justice system.

I think they gave him a picture book too early in the trial.   Now they have nothing to distract him.  Sad

A textbook narcissist, he is got so many of the traits and tactics of narcissists that should be a case study like...

- his projects are "the biggest projects ever seen" and anyone who dares to question absolutely anything is described as a hater, criminal, conspirationists...
- Any and all failures are described as either "achivements" or "caused by his enemies". Responsibility for actions is nil, and once people do not serve his purpose he goes into full offensive onto them (e.g. the Vice president, his layers,...).

Unable to recognise any mistake, when there is objective information or data showing those, he denies the data, the producers of the information, the media that publishes it and even the colour of the background if given opportunity (e.g. unemployment data).
