BS they are shipping X-3's and just didn't post notice anywhere! That's another lie these scumbags are spouting.  Do we really believe that anytime they had remotely good news they got on their main account just to say it, even though they have the lowlife David for that, and probably the biggest news, shipment of their flagship device starts, and they just don't update anywhere.  I am yet again calling BS.

Also, unless your sueing for some other reason, they probably won't need to be able to produce that evidence as it is in your right to request a refund at any point.  Good luck to you sir, hit em hard.


Ya think?  X-3's are going out and they simply haven't had 30 seconds to post that here or or their forum.

More likely that if they do start shipping they won't let people know or provide tracking #'s so they can't contact the shipper to stop the shipment.

IMO, every move has been tactical.  if X-3's are going out and they haven't let people know it's because they don't want people to know.  More likely, it's a misdirection statement, with just a hint of truth.

they've shipped 1 to somebody, therefore X-3's are shipping, or something along those lines.  they have been very adept at looking like they're telling the truth while in reality telling half of it, at best.

I asked for a refund this morning stating that I will give the go ahead for my lawyer in Shenzhen who will work with my lawyer in The Virgin Islands and continue discussions with Scotland Yard if I don't have shipping info by the end of the month as it's the last promise I'm prepared to take. 
 
I will not sit quietly anymore after investing US$25K in this company and will happily spend more to regain that investment from them plus compensation if the lawyers do their job correctly.
 
I hope they actually don't send my X3s now because I will have a better chance of return through the legal system.  I'd love to see them produce the documents that made them decide they were ahead of schedule back in January let alone all the other documents they would need to produce to show why they have gone against almost everything they have told us.  i.e. documents to show the LCD orders from multiple companies and every document showing orders for each revision of board etc.  I don't believe they would be able to produce them so as my lawyer has stated... Should be a walk in the park.
 
This is the reply and if they are true to their word about their production capabilities (again, documents will be required) then it should only be a matter of days before they hit my order.  If I find that they've shipped to re sellers first then I'm not waiting for the end of month.

Consider this scenario:

a. After months of cooling in oil the obsolete hash boards are removed and built into X3 miners for customers.

b. The miners are shipped to angry customers.

c. The customers plug in the units and start hashing in spite of the fact they'll never recover more than 10% of their investment.

d. The heat from the ASICs vaporizes the residue oil on the hash boards and quickly fills the room with an explosive vapor.

e. The capacitors that can't explode produce only sparks.

While I appreciate that, I have been thinking it over for the past week. There is no longer the possibility to earn an ROI and as I am not a business, I have no ability to continue to afford having to continuously purchase newer equipment as quickly as the difficulty has progressed.
 
Under FTC guidelines and Washington State consumer law, I have a right to a FULL refund as my purchase has not shipped at the time of request. Please process my refund, I believe I have been more than patient with Black Arrow in this whole debacle. I hold no ill will towards Minersource in this, I understand you were just as helpless as we were.

You are hereby notified that I will be going forward with filing complaints with both the Washington State BBB & Attorney General, the Colorado State BBB in Denver & the Attorney General. I have just finished filing my complaint with the FTC, reference #54876592. I am also speaking with my council with what options to pursue.
 
I have now lost any respect I had for Matt aka bobsag3 and Dan. This blantant and willful disregard for my request is disgusting.

That does not matter in the eye of the law. I requested it to be cancelled BEFORE you shipped it.
 
FTC Rules, which you should read, because you have violated multiple, states:
 
You must cancel an order and provide a prompt refund when:
the customer exercises any option to cancel before you ship the merchandise;
 
And
 
© To fail to deem an order cancelled and to make a prompt refund to the buyer whenever:
(1) The seller receives, prior to the time of shipment, notification from the buyer cancelling the order pursuant to any option, renewed option or continuing option under this part;
 
 
Since you responded to my first request for the refund, even though you said it was after hours now, you acknowledged I wanted to cancel my order and demanded a refund. The order had not been packaged and shipped according to your email, but would be today. I responded that I did not want the order.
 
I have already spoken to UPS and the shipment will be refused.
 
I have filed complaints with the Washington State Attorney General, Colorado State Attorney General, Missouri State Attorney General, The Federal Trade Commission, and the BBB for Denver Co and Washington State.
 
The law is on my side in this matter. If you wish, I will put you in contact with my attorney let the court decide. This would end up costing you more than if you just refunded it.

So we're now about a week after they were supposed to start X3's and not a word, something really horrific must be happening that they are not willing to tell us.

The X3 has back plane problems and can't work. The X3 hash boards have been undergoing physiotherapy at the cloud hashing facility since May. They're going to return to work for customers after a few more months of difficulty jumps.

A little excitement today.

Go my 2nd X-1 in the mail.

Pulled it out of the box and set it up on my desk plugged the cable into the back of the unit and then into the powerstrip. There was a thunderous electrical crackle and spark and the room went dark.

Looks like the power supply died and popped the circuit breaker along with it.

This is the first piece of electrical equipment I have had die straight out of the box that I can remember. It sure does smell bad!

Hmm I'm struggling over here. I can't get my unit stable at all (BTC guild spamming 20 idle notifications a day...) and I can't upgrade its firmware.

It doesn't make sense that they would build a giant mine using bitfurys expensive 55nm chips when their chips likely cost a fraction of what they could buy bitfury chips for.

It does make sense when BitFurry is the only stock left. I tried to get them in late November but somebody snached up all the stock everywhere. Too late for the Jupiter and no BitFurry stock left, as somebody said BA had the least fleas and they looked like the next KnCMiner.
