Now wait and see if they delete all of their past "news updates" too. They're trying to erase their tracks, so the lawyers don't have as much ammunition. Too bad about that pesky Wayback Machine and FightAlpha.net...

I'd ask for a little more clarification on that 'fixed' price, I've paid more than three times that amount to get to the point of the court date and solicitor's attendance fee with them.

The price they mention there is just to get the court application filed and then Alpha get to file whatever defense they think they can muster against it and then it can go to small claims court, whereupon there will be additional fees to pay for the hearing fee and the solicitor's fee to attend it.




Yes, you're right about the court hearing fee, but not about the solicitors fee (that is included in the 380GBP). The court hearing fee is a fee charged directly by the court and it's 150 or so GBP, but it was fully recovered by LPC law as well. Once Alpha is found to be "unreasonable in it's dealings", then almost all legal costs are recoverable.

It should have been 8.5%, it is fixed by law rather than just a made-up number they think is reasonable.

Ironically, this is ONLY applicable to business to business transactions, something Alpha have been very keen to tell everyone is indeed the case!

Note: Alpha is FULLY SOLVENT. Another claimant had 15,000 GBP Judgement and issued a winding up petition against Alpha.

I was actually quite surprised with that result. I figured that they would have moved the money off somewhere else and would then let the company get liquidated. However, it seems like they are trying to keep the company alive - hence they paid me to go away.

As a result, I would suggest that you press ahead with your own petition. I would also suggest keeping this news off the forum, and just communicate if (if you even see fit) to your paid-up members - probably more effective if they don't know that a petition is coming (until your lawyers tell them it will be unless they pay up immediately). Once the petition is served on them, the Court date is set for approx 4-6 weeks in the future.

Also keep in mind that the money you put in to serve the petition:
1. is the first to get paid back if they get liquidated
2. will get returned to you by them if they pay to you go away

I did wind up with some costs in getting the petition withdrawn, and the Court had not assigned me all the legal costs in the judgement, but I came out of the experience with a pretty decent proportion of what I put in.

If they bother making another 'news' announcement it will either be more excuses or to declare they are bust as a business.
