Luke patiently explained to me that "received" and "shipped" are terms which have new meanings in this crazy digital age, it is now possible to receive a shipped item without it actually being delivered. Therefore any suggestion that he hasn't received his unit is "slander".

I thought this was an interesting perspective.  Roll Eyes But he clarified things by telling me that he was only referring to the definitions of "shipped" and "received" which were set down in the shipping bet- the bet he called badly worded, flawed, and said he had nothing to do with; the bet which he doesn't want to be associated with (and how dare anyone associate him with the bet). But the definitions are a different issue, those he is happy to adopt, but just don't tell him he's acting in a misleading way, because it was the terms of the bet that were misleading when they were first posted on the website, but when Luke uses these terms he is just being honest and consistent- to suggest otherwise would be "slander". True story.

Luke-Jr told me on IRC last night that since BFL offered to ship him his unit, but kindly agreed to keep it in their warehouse and send him pictures instead, that the unit still qualifies as being "shipped" to him. They did not ship/deliver, Luke_Jr already admitted that on 3rd April (below)

Like I said, I'll probably have them ship it to me when the rest of my order is ready to go as well. I certainly prefer they NOT ship it until at least the next difficulty adjustment Wink

In their defense, the bet could be argued to require +/- 10% as delivered (eg, disqualifying firmware updates), but if this performance issue had merely been my software, they'd have defrauded people...
