Decided to proceed with caution.
I suspect I may continue sales one day but until I can figure out a method that I am comfortable with and does not constitute as "Money Transmitting" I will not.
does this still apply now that they have said Bitcoin is handled more like property?
As far as I am aware my funding customer coins is still "money transmitting" although Bitcoin was declared to be property by the IRS.
Would it still be "money transmitting" if you sold unfunded coins but made the customer send the amount to be funded to a trusted third party in advance who loads the coin after a reasonable period of time.
I am tinkering with the idea of selling the coins I still have with the appropriate and genuine holograms marked with laser etching on the hologram "SELF FUNDED" as well as changing the vanity addresses to normally generated BTC addresses for the window on the hologram. Certificates would not be given here. Although I still have leatherettes and capsules for the coins itself.
Bitcoin sets could likely still be made as I still have the resources and supplies to do so should I go this route.
The idea would be that customers would purchase the coins and would fund them themselves and I would not have taken any part in any "money transmitting". Basically I would be selling the equivalent of metal circle gift "cards" with a hologram covering the password to said funds to be loaded at some later date by the user.
The agreement to this would be that users would understand the risks of allowing myself to have access to the only copy of the private key. This would be the same terms and conditions only that I would not be funding the coins as I have in the past with user funds paid prior to shipment.
I may consider an option (no promises) to sell coins with no holograms at all on them nor private keys.
Of course before I move forward I will seek legal counsel on this matter to make sure I have all bases covered from a risk-standpoint.
There appears to still be quite a lot of demand for these coins and so far I've had to deter all interested parties and ending with the sentence "hopefully I resume sales soon."
I'll update as things progress here and in my other threads as well as the website.
Edit: To be clear the coins I am referring to are all marked "2013" and if things work out I may end up having manufactured "2014" coins and holograms etc. We will see.
