hmm not really provable.
I did went back to the beggining and it is not an mtGox wallet or there is no proof that it is.

Another point, not to give false hopes or try to glorify Mark:

With the official statement about the "missing" bitcoins possible not being an attempt to "steal" anything, or cover up their own incompetence only.

Could it be considered a move to keep control over the coins to hedge against price changes?

Mark is in a situation where they can't know the official position of Japanese law or the value of their bitcoins when the score is settled.

Could it be that Mark is still legally in control of our coins, claiming the right to sell and buy as he pleases to preserve as much as possible of customers assets?
He is still the CEO of the company and probably able to suggest financial dispositions to the court appointed overseers.

If that's the case, he is more or less set up as he pleases, without customers withdrawing funds and the court talking its time while protecting him from lawsuits.

Does anyone know Japanese bankruptcy laws well enough to tell me if it is possible to strike such a deal in secret, maybe on reasons of not causing more panic or influencing the market, or is this a totally speculative bonkers suggestion? Are frozen, or held up, customer funds considered an asset under Gox's control until Gox's fate is determined?

Explain to me how they were able to get BTC out off Mt.Gox with it not showing in the blockchain?  Were is the evidence of Bitcoin withdrawals?

Good question. All transfer of btc ownership does show up in the blockchain, unless you have the private keys, and just give them to someone else, then there will be no evidence on the blockchain until the new owner moves them. The risk of the giver retaining the keys after giving them to the third party however, means the third party is likely to move the coins right away, wich will show up in the block-chain.

Big chunks of btc not moving indicates that the private keys are either lost, or retained, and the one controlling them haven't bothered about moving them.

I will just add that I have absolutely no trust in the Japanese legal system to sort this out in a honest and trustworthy way. Most likely the btc-part of the heist won't even be touched upon in Japan.

The most important number, obviously, is the 951,116.21905382 balance. As you recall, Mt.Gox filed for bankruptcy while stating a 850,000 BTC loss. This would suggest Karpeles’ estimates were off by a large margin. Whether all of this is accurate or not is an entirely different manner. What the leak does show us is how easy it was to grab nearly all of Mt.Gox’s user data as well as how hardened Karpeles’ blog was. Furthermore, the files contain the app Mt.Gox admins used to manage transfers. A screenshot appears below.



Who hacked Mt.Gox? The leak contains some clues. A visit to the above-mentioned mirror brings a link to the zip file and a note: “I hated working with you. You deserve everything you get for what you did.”


 

He is not off by a large margin. There were about 80.000 BTC in suspicious or hacked accounts that were not counted.
That is what is causing the difference.

Tinfoil hats are in reality made of Aluminium foil! They are just called tin foil hats to confuse conspiracy nuts.

Oh great, apply logic if you will, but the point is to ensure metal hat of some kind.  I myself use a tin pot, lined with aluminum.  And since I never trusted Gox, it worked.
Lame. Those of us *in the know* have had our foil surgically implanted between the scalp and skull. It allows us to work unseen and undetected and provides a cool crinkly sound when we wear our fez hats.

i got the upgrade installed, fully rubber lined in case of lightning strikes, and it reduced the fez-fuzz. you should look into it.
