The truth is, we don't know jack shit about the miners and whether they even work or not. Not a single person has received one. So based on that, I'm surprised you'd think this can be a WIN-WIN situation for ANYONE. Even if we do get refunds, that fucker has sat on all of our funds for well over 3 months. The interest alone makes Joshua Zipkin the winner at the end of the day.
P.S: We don't even KNOW FOR FACT if Joshua Zipkin is in the United States. No one has here personally met him; but let's all just ASSUME he is because it makes us feel better that he in the end that if he's here in the USA, he might be held accountable for this mess.

A: Mine altcoins. I do it now with my proof of concept setup and mine a consistent amount that converts to bitcoins. I use tomcoin at tompool. Alternativley megamultipool does the same thing. altcoins convert to bitcoin without having to have a zillion wallets. Just your bitcoin wallet. There is your ROI. This method is a bit more resilient to the difficulty issue. Not immune but it works. I have had moderate success with my current setup. Numbers simply dont lie. You are entitled to your opinion on that while I have a growing wallet that trumps the opinion.
As for your other points you are right. We dont know. BUT if it works as the bitmine spec from all indications they are using their reference designs, then it SHOULD work.
This isnt shilling I am just basing it on the facts in front of me. And the facts are that. If he gets a broken miner then he has ALL the legal ammo he needs to go after them. Their specs are +10/-10% if it performs less than that then clenell has the smoking gun he needs. No matter how you slice it he wins. If his miner works as advertised he wins because he can at least make his money back. OR sell it. Whatever. But he wins.
clenell can confirm quite easily if he is in the US just has to check his cell bill....OR depending on his plan he would not have been able to call him international. OR he would have a 3 dollar a minute charge to his calls (depending on carrier tmobile its 20 cents). Even if it was a local number. Obviously it was a domestic cell and domestic call. But once you leave the US roaming becomes an issue. I travel internationally and have had this issue with 3 of the 4 carriers (tmobile is the exception in that rule)
Based on how they have behaved in terms of communication I wont defend them. BUT I will provide perspective as to why they MIGHT be doing something. Some of the actions they are taking as a business make sense. On the other hand it could just be what everyone has been saying. No one knows for sure but it helps to put the various possibilities in there to think about.
I know there are those that want him to be chilling on a beach in Bulgaria or whatever. I think the truth is alot simpler. (my opinion here just as you have yours) They just are not good a communicating to their customers. They likely don't have the right marketing people or PR people. They have had to backpedal because of suppliers delays. They over reached and have not met targets they promised and got burned. This to me is much more likely than a scam in this case (vs some other patently obvious scams). They have a shot to make it right but its gonna take ALOT of rebuilding good will with all the people they have wronged and are wronging. This community is overall still very small. And their google SEO isnt good either. Right under their home page is this thread....which is going to hurt them until they fix it. New people are going to see the first 4 searches on them and question the need to do business with them. This is not shilling this is a realistic and objective assessment of the situation. Personally I wont do business with them again until they can turn it around reliably. But from this point I will just wait it out and request my refund after the 31st. I had planned on doing it sooner. Way I see it I will win if I get my miner or my money back (in which case bitmine or some other PROVEN reliable supplier gets my business)
