friggin amazing, i just got a email that my order 6## is ready to ship and they want the last 50%, even tho i asked for a refund months ago.
and i was told to wait til b1 was sent out before i got anything

Reason for 50% in advance payment was receiving funds for your order assembly and purchase of the required parts. As money has already been invested in to production and your unit we are unable to issue the refund until we are able to sell unit to other customers.

It is bullshit.  In fact, they said repeatedly that they were not getting the majority of the money from preorders.  Said it on this thread and said it in this article.

Chinese consumer law also apparently says that in terms of pre-orders this money has to be kept in a separate account.

And yes, their TOS indicate Hong Kong law FOR THE TOS.  The plant is in China.  It stands to reason that you cannot set up a factory in China, or any other country, and simply ignore the laws there so you can do whatever you please, and strip people of their legal rights.  

Or maybe the Chinese are just fine with people throwing up factories and just doing whatever the hell they want.  From what I've seen they're totally fine with that type of loose cannon behavior.  /sarcasm

Because they are a giant scam and know there products are worthless now which is why they would rather illegally refuse your refund and instead opt to send you their out of date crap.

As to what you can do, start complaining to government bodies, there is a thread somewhere that has the pertinent bodies to address complaints to, and hope they do something.

They have plenty of money, they're just running out of money that they don't want to steal. I have never to this day heard a single report of a customer having paid BA directly in bitcoins having seen their payment ever leave the payment address supplied by BA.

Thats true, you are very right.  Although given their high IQ level, I would wager a guess that they lost their private key and can't access those coins anymore.  Smiley

1) Nobody's buying from them, most of us are preorder customers still waiting for delivery of our purchase since late last year
2) It's not more expensive to buy from competitors, its cheaper


Not talking about mining gear (although that too I guess).  They are trying to sell excess parts such as capacitors and other equipment needed to build a PCB board with their chips, and they say they will sell them for cheaper than their other companies selling capacitors and other components(who are their competitors), to which I said, "do not buy from BA, buy the components from their competitors, even if they are slightly more expensive."

They decided that they cannot build a miner that works (and we know they didn't design the chip), so they are just selling pieces of a mining rig to end users.  They have gone from a manufacturer to a whole seller, and are just as shitty in that role as they were in their previous one.  It is obvious they have no money, and are trying to scrape together whatever they can before they die, get your complaints registered and refund requests in before its too late!

We are running 10 Prospero X3 in our data center (20 units of 1Ths) and so far stability is quite bad. We have to reboot some machines every few hours, and one unit is not functionning at all already. Instead of having a theorical 20 THs, we average 16-17 THs / day (we don't have 24/7 presence to reboot machines all the time, nor have auto switching plugs).

No idea why it's not functioning all X-3 i tested were running for week without performance drop and above 1TH/S per case.
Also there is a problem with 1.8 update as i heard, that causes problems to X-3 makes them run not at full spec. Better not update to v1.8 and if you did wait for v1.9.
You can also check PSU for the ones that stopped working, looks like there has been some problems with original PSU supplied with X-3.

The distance in time between me and my money is now 9 months. BA appears to be using their ToS as an excuse to keep my money and not ship my miner until its value is 0 if shipped at all. Nobody agrees to be defrauded.

An X3 currently makes $15 per 24/h (power included @ 10¢/kWh). It's 3 20% difficulty jumps (6 weeks) away from the garbage can.

Compensation units sent out after shipping is complete? LOL

That's like shipping the customer an extra box of rotten tomatoes to compensate for the first box being rotten.

Is it possible this is just another Zifkin operation? I mean for all we know this Sovu guy is just a fugitive with his name on a holding company obviously designed for criminal purposes. We have evidence that someone did some press last fall to promote this scheme under the criminal alias "Alex Berk", which frankly is such a ridiculous load of Where in the World is Carmen Sandiego bullshit it's almost comedy. All we're actually hearing from are three fake and/or anonymous entities that we know nothing about. They're EXACTLY following the Zifkin plan leaked by PG to a T.

The only question that's really up in the air at this point is whether Matt Carson and this "Stuart" guy from the UK are in on the con game, or whether they're just useful idiots getting played. The take on this scam is probably good enough that it's worth running their reputations to the ground, not that Matt Carson wasn't already a known scammer to begin with.

The irony here is that they're going to throw a hissy fit about your outburst right there which is just frustrated words that hurt no one, yet they will continue to defraud their customers as though that's totally fine.

It's only a few hours, and they are not yet on definitive production site, but we have 6 boxes running each stable at 1Ths.
It makes a lot of noise and the heat is huge, especialy with all the units stacked.

Our order seems to be complete, without of course 5 more compensation units (no idea when we'll receive)

I'm going to lay out very clearly and logically why this entire thing stinks and is a scam from top to bottom, even though there is at least some evidence that there is some effort to actually deliver a product here. To any of the schadenfreude "preorderlol you're dumb" crowd, that's nice you're more than welcome to feel good about yourselves.

A pre-order does not mean that Black Arrow has zero responsibility for delivering and gets to do whatever they want as they please whenever they want.

The agreement Black Arrow entered into with us was predicated on a set of representations of the project made by Black Arrow at the start, specifically that there is a design that BA is producing that meets certain specifications and requirements, and that the organization has the ability and intention to produce the ordered end products and services within roughly the agreed upon timeframe. Of course it's reasonable then in this framework for the delivery date to be an estimate, because of course there are going to be some unforseen issues in producing the end product.

Now once Black Arrow in the eleventh hour announced the original delay, we were no longer under the same agreement that we originally consented to, because in failing to produce a design that met the agreed upon specifications, we were no longer customers of the original project. It is at that point that BA is obligated to contact their customers to determine if they still want to be involved in the new terms of what they are producing, and offer either some kind of discount or enhancement of product, or a full refund if the customer no longer wanted to be part of this modified project that they did not agree to in the first place.

By failing to conduct themselves in a way that honors the way that they represented the original agreement, Black Arrow committed fraud by going ahead and using customer funds to produce a later and different fab than what was originally agreed. BA has an obligation to sort out this situation prior to going ahead and producing the fab. Just because a customer pays a company for a product or service, does not suddenly mean that the company is entitled to go ahead and force the customer into something that the customer never agreed to.

Now that we are faced with an even greater delay since BA received the finished fab than the original delay in the first place, we have to recognize that BA misrepresented their capability and willingness to actually honor delivering a finished retail product. Literally every single thing that BA said in order to solicit orders, which is well-documented even within this very thread, has proven to be a false misrepresentation of the facts of their conduct and performance.

This entire history of changing the agreement unilaterally without the consent of their customers means that the original agreement is long gone, and BA's unwillingness to recognize that reality means that as customers our only recourse is to bring this situation to legal channels where BA will finally be forced to liquidate their fraudulently-acquired assets and compensate customers for what they've cavalierly done without consent. As long as BA continues to maintain their perverse interpretation of the terms of the original agreement, i.e. that estimated delivery date means that they get to do whatever they please whenever they please, then there is not going to be any recourse in attempting to deal with BA (as though one could even actually contact them ever about it anyway!).

I messaged Minersource again, asking for an update on the LCD and compensation and to ask for a partial refund due to the lie I was told about my ordered being valued at $100 when it wasn't. So far it seems they dont give a shit and ignoring my emails.

So if anyone is considering buying from minersource, just stop, because as soon as you have an issue. They will ignore you!
You honestly need to file a claim with the FTC to get their attention. Once you have their attention, they can be reasonable people from my experience.

Just do the one about not receiving an online order and no prompt refund was issued. It doesn't matter where you're located, only that the company you're filing a complaint against is under the FTC jurisdiction (which Minersource is).
