I'm not allowed to argue the multiple accounts issue, because I want to keep my preorder.

What is there to argue? You already admitted that Werner, who has stopped posting since one minute after the post in this thread is you.

Sorry for calling you liars. Werner is a sock puppet account under my control. Sorry for utilizing said account to "troll" you.

                                         With regret,
                                                     Garr255

I don't appreciate you taking my quote out of context.

In order for me to keep my pre-orders Josh is making me do the following:

  • Apologize Publicly for calling Josh and BFL liars
  • Admit "Werner" is a sock puppet account uner my control
  • Apologize for using "Werner" to troll him

Therefore, in the best interest of Cognitive, the people who have purchased pre-orders from me, and myself:

Dear Inaba and BFL:

Sorry for calling you liars. Werner is a sock puppet account under my control. Sorry for utilizing said account to "troll" you.

                                         With regret,
                                                     Garr255

Also, I apologize to all who I may have put at risk by speculating that BFL may have been acting in a dishonest fashion. If I had known that the cancellation of orders placed by me would result of this I would not have acted in such a way, as that would be a direct violation of the fiduciary duty imposed on me by handling others' assets.

Just my 2 sad satoshis here.

Inaba,BFL: You are a disease on society. Glad your little ponzi scheme will be over soon.

You pray on the weak, the ones that put their trusts too easily.

Phinneas Cage: I tip my hat to you sir, speaking your truth, but in the end THE one and only truth defined by facts alone.

Xian01: Very impressed. Someone had to start the legal thing, you took responsability!

LainZ.

BTW, the case is a federal offense, so maybe justice will be able to ask for his private key? (key disclosure laws?) For "expectancy damages"? That would be great!

Yes. It's been discussed in other threads before. Barring a few diehard BFL fanbois who think that the law does not apply to them.. the general opinion is that the court would simply order BFL to pay damages (which they clearly owe under contract law). If it does actually end up in court, it's extremely likely that BFL would settle as soon as they retained legal counsel.

FTFY. You are not a lawyer and have no understanding of how the law actually works, so I forgive your many errors.

The most cogent discussion of this in the Legal subforum is here: https://bitcointalksearch.org/topic/m.2290818

Contract law is all about making the damaged party "whole", ie. recovering their losses. If the purchase price is refunded there are no damages. Potential lost profits on a speculative crypto-currency don't count.

I doubt the parties here will end up in court, but I'm curious as to the basis for this assertion.

In a breach, a party's damages can certainly exceed a contract's consideration, and outside of the contact itself, I can think of nothing that would bar a claim for lost profits, no matter how speculative. Is there some case law that leads you to conclude otherwise?

No. It's been discussed in other threads before. Barring a few profiteering lawyers who think they can make the case float... the general opinion is that the court would simply order a refund of the original purchase price (which has already happened). If it does actually end up in court, it's extremely likely that BFL would counter sue for legal fees and libel (and likely walk away with a decent sum that would then be impossible to collect - given the attitude of those threatening legal action).

That being said I think it's hilarious that people continue acting out - ffs gar you have the earliest bitpay order the only people in front of you were existing fpga orders that converted to asic... it's a good thing - you're close to the front of the pile... please just unplug and wait a month and then be thrilled with having received your orders.

This is the point:

In order for me to keep my pre-orders Josh is making me do the following:

After Gree's 'performance' with his multiple accounts and posting on Reddit and trying to cause damage to the business, I'm bloody surprised!! Is that all??

I have no idea why you would make something up such as me posting on reddit? I don't use reddit.

I'm not allowed to argue the multiple accounts issue, because I want to keep my preorder.

I come back for one day to Bitcoin to see the products that BFL has completely skimped out on, congratulate the people who finally got them, and all I'm reading is Josh & BFL trashing their own customers. They have no right.

Quote
im going to say this your all idiots you loose your temper you get punished.... and rightly so u would cancel anyone's orders that was proving to be aggressive or unreasonable.

*Hands a company over $1,000 in cash. Doesn't receive a physical product in over a year with little communication and lies.*
Yep, everyone is unreasonable and losing temper to right justify their year old orders to be canceled. You hit the logic nail on the head.

(And some paid for minirigs, they gave them even more money than a measly 1k.)

Yea I agree everyone has the right to voice their opinion without oppression. If BFL did not take so long there would not be any back lash.

Everyone who orders Now and In the future are and could easily be considered idiots. I don't see BFL doing well in the future along with their customers.

After Gree's 'performance' with his multiple accounts and posting on Reddit and trying to cause damage to the business, I'm bloody surprised!! Is that all??

All you people in this thread DO KNOW what 'Corporate Espionage' is right?? That it can carry serious jail time. Personally I'd cancel his order and tell him to fu, but hey ho, I'm a bit harsh like that. Piss me off, and I remind people that I'm human.

edit: and if I thought he had caused any serious damage to my company I'd drag his backwards through the courts, but I can be evil like that Smiley

What is 'Corporate Espionage' for you?

Lying about my businesses practice, creating false accounts to perpetuate that lie and cause further damage, posting/telling people in numerous media sources about the same things. Even after having the situation clearly explained, continuing to post in multiple media sources and with multiple accounts to attack/degrade/disrupt my businesses performances.

What does it mean for you?

edit: p.s. if it was MY business that is.

Quote from: Wikipedia
Industrial espionage, economic espionage or corporate espionage is a form of espionage conducted for commercial purposes instead of purely national security purposes. Economic espionage is conducted or orchestrated by governments and is international in scope, while industrial or corporate espionage is more often national and occurs between companies or corporations.

I don't get it ..

Someone set out to attack Inaba/BFL, lied and used a sock puppet account to troll and cause grief (and actually, in some circles this is called 'corporate espionage' and can be brought to civil courts).

And Inaba/BFL is the 'bad' one ..?

Yes, he swore a bit and lost his cool momentarily, I'm sure that if you knew what he really wanted to say you'd be really shocked. He's a freakin human being, just the same as anyone else.

I don't think it was ever in his job description to be the whipping boy for bullshit and attacks. Not sticking up for BFL, as they were late with finally starting deliveries, etc, etc,

BUT ... I don't get it .. in this instance .. Gree gets caught and called out ... And Inaba is the dick/wow person?

As far as I see "fair play Josh for keeping your cool as long as you did, don't forget, there will always be trolls and haters, and the more you succeed the more they will appear."

edit: and btw, it seems that it was explained clearly to Gree that his '1st' order was NOT the '1st' order, as the previous orders already in place had priority (obviously).

This is exactly why ASICs are bad. I realize that half of wholesale AMD vendors are retarded too, but there are ALOT of them to choose from.
Doesn't matter if these forums are good or bad, any sane company shouldn't behave like this. And if the employer doesn't send this forum troll to hell, they are just as bad as he is.
Most likely rumors about wtflabs burning rigs before shipping is also true after this. Monopoly's just suck.

P.S. Globally not happy about ASICs, anyways i'm happy i dealt with ngzhang and co.

The order was a Jalapeno initially. I paid to upgrade it to a 60gh/s SC Single, and BFL confirmed that I would not lose my place in line.

The bit-pay guys know the number BFL's database started at, and it was with my order. I placed it within ten seconds of BFL opening the forms, and nobody on the forums claimed a previous preorder until BFL started lying about it. I'm not going to be easily convinced that over 50 people placed orders via paypal exclusively in those ten seconds.

BFL: What's your excuse for this one?

Calm the fck down,

The reason why there are orders b4 you was the last FPGA orders were allowed to convert to ASICs. They've automatically become the first ones in line.

For new orders, its true that you're the first.

Nemesis is correct. There are a number of orders that are before the first Bitpay order, dating back well before #1600.  Garr, you can officially piss off at this point and take your accusations and stick them straight up your ass.  I tried to be nice and I wanted to help you and you give me all sorts of shit and accusations.  This is why we no longer give a shit about this forum;  Everyone here is monumental assholes, no matter how accommodating one tries to be.  Garr, you'll get your order when it comes up in the queue, I'm done looking into your problems or trying to help you.

BFL can cancel orders for any reason (excluding discriminatory ones like race, gender, etc.), and if they refund the order money there's no harm done, in the legal sense.

Not true. I've been informed this is a Breach of Contract and Civil RICO offense.

Contract law is all about making the damaged party "whole", ie. recovering their losses. If the purchase price is refunded there are no damages. Potential lost profits on a speculative crypto-currency don't count.

RICO, as in racketeering? Please.

If what you say is true, then I could buy a future contract to sell one ounce of gold at $1600 2 years from now. If the price of gold is higher than that, I "refund" the original price to the contract holder and unilaterally dissolve the contract, otherwise I just buy the gold for cheaper and sell it for $1600. The other party was expecting to be able to buy that ounce of gold and then turn around and sell it (or use it) at a profit. They waited 2 years for that opportunity, and I took it from them by "refunding" the original price.

Your interpretation of contract law would destroy every futures and options market in the country. It would also be mistaken.  Wink

You think the courts are using standard contract law to manage the insanely huge, heavily regulated financial services industry? Dude, the US legal system is a bit more complicated that you think.
