Here it is clear that the wallet has last transaction in 2011 which is indicating directly that user of this wallet or address is no more able to access , so he left this one .
So use it without any problem and tension .And use it in better way to grow this amount of Bitcoin .

YOu are super lucky dude. I can not imagine how lucky you can be. With 40 bitcoin, you can do whatever you want and buy whatever you like. Perhaps you should spend half of your 40-Bitcoin into some charity activities. They will be more effective than spend all of your Bitcoin in one place
