To me you should not take it as it looked like thief to me. The owner of the wallet may still has the key and keep his or her 40btc as a life saving. Don't be an idiot. The money is yours. It is not illegal to transfer bitcoin if you have the key to do it. Having the key means it is your bitcoin. Take it and transfer it to another address before another key holder does that.

Not really, what i would do is to donate 39 BTC to people who needs it. Like donating to projects everyone use, but no one donates to, like UNOMP, BCOIN, and many others. I would keep 1 BTC as a reward for fair distributing the funds.
But the question is, how did you found a private key in a forum, with 40BTC in the wallet ? normally as it is existing since 2011, it should have been aleready emptied.

Yeah I really doubt that you would do that if you were the person with access to over 40 thousand US dollars. People always say that they will donate money if they got it, but when they manage to get that money,they just spend the money for themselves. Maybe you should make a more realistic goal like maybe donating 1-5 Bitcoin to those things. I would say that if you have access to that 40 Bitcoin, then you should just take it, if you don't, someone else might and they might not be the actual owners. And it is not like you are going to get caught for taking that money.

I think if you already have access to get into your wallet or have a private key for the wallet. I think you've become a chooser legitimate. after all, there are no laws and regulations in bitcoin

i think if he can give the proof that he own the wallet with 40 btc, maybe we can believe and we can helped him to transfer the amount into other wallet. but if he only tells us that he own the wallet, then its hard to believe it because i don't think that the wallet is really have 40 btc inside and if its true, then he is the one of the richest man for now.
