I'm shock that among my IT peers. I got quite a few ppl completely ignore btc and think its a ponzi scheme....

They never did answer the question regarding sales/income tax, which seems rather important.

They answered this yesterday. The IRS is actively working on rules for virtual currencies, but they are not done with the guidance yet. No one will know until this guidance is released.

No one from the IRS has been on either of the panels.
Is it the IRS' job to decide if something is a capital gain or not?

Yes, Internal Revenue Service determines taxation on revenue across various types of income (short, long, income, dividends...) at different rates. Get out of thinking about avoid taxes. Or move somewhere else.
