realistically I think in 5 weeks all these chips could be fabricated and shipped out even with a small skeleton crew, something else is in play, wonder whats going on exactly, hope we get some answers this week or this month...

So NG Zhang is answering emails. Yifu seems MIA (no activity posts on reddit for a month as well).

I'm sure they would love to get their feet wet with alternative currency cybercrime. It would set a precedent.

Still I think you need to wait a little longer yet, this is still flakey, but Avalon B#3's are arriving, so there is life at Bitsyncom, even if it's life that refuses to acknowledge it' customers after breaching agreement...

It depends. They may view it as people just fucking around with the equivalent of "video game money" - no one gets prosecuted when thefts happen in EVE online, because it's a game.  And not only that, a lot of people view it as a way to get around government regulation.  People in the government might take that as an affront and think "Well, you're on your own then".

Also, in order to prosecute as a theft, you'd need to prove that Bitsyncom actually stole something, and didn't just fall behind schedule. That's not a crime, in fact it's actually really common.  It's just that most of the time, delays like this don't completely destroy the value of the product.

There's also the problem that everything happened in China, which would make prosecution quite difficult.

In the future, the best thing to do for a large chip order would be to license a design.   Rather then dealing with Avalon/BFL/whoever the thing to do would be to pay whatever company BTCX and they'd write a letter to their upstream provider authorizing group Y to oder up to X chips direct from the fab.  They'd pay the the design company and the upstream provider separately, and that would remove one point of failure from the whole process - in fact, the most likely source of failure as they'd be a very new startup liable to have all sorts of problems (as we can clearly see from BFL and Avalon)

Good luck with this, man.  You're here at the exact point I was when I threw in the towel with Avalon, and, except for the innocent Open Source victims, when I threw in the towel with anyone involved with Avalon.

Why?  Because the pictures of those chips was the biggest of news.  I tried to get some bi-lingual Chinese to tell us what really was being said there (i.e., imposing any cultural inferences over the issue as well) to no avail.  Go back and read the thread.

At that point, I just thought, "Something's going on; there's a million chips here, they don't seem to be clearly titled to Avalon, and nobody is willing or able to say what's up in Shenzen. My gut feeling is Avalon is fucked, I'm not vested in Avalon, so: to Hell with them all."

Maybe you'll get somewhere.  I hope so, for the sake of the Open Source builders.

As much as we would like to have what we paid for shipped,  a wanted dead or alive proclamation may be considered a "death threat"  in the USA and could land you in prison.  ;-)
