The bear market ruined many icos this year and the scam projects give them a bad name, but I think it's a good way to fund new projects. This should evolve in the future.

Yes, it was announced in the Official pages of the SEC, they want to integrate such thing when returning of your assets in case the ICO appears unsuccessful will be possible. They want the securitized tokens to be the securities.

Yes. There should be sanctions or punishment for ICO's that will scam its investors. Also your question on when will thw hype end for crypto, we can clearly see that it has already ended since there are only few investors left and it extends the bear market. The crypto currency is on dry spell right now.
